Will devised June 11, 1885. Proven May 11, 1899. I, Solomon Jones of Henderson County and State of North Carolina, being by occupation a farmer, make this my last will. I give, devise, and bequeath my estate and property, real and personal, as follows, that is to say: My real and personal estate on “Mount Hebron” in Henderson County, North Carolina to go to my wife Assena T. Jones during her mortal life, then to be sold and divided equally among my first wife’s children, and if none alive to my first wife’s grandchildren. I give and devise Thirteen Hundred and Forty-three dollars joint stock in the Middle Saluda Turnpike Road to my sons and daughters as follows, to wit: William Jones, Hicks Jones, Elizabeth Sentell, Eliza Fanxler? [Tankersley], Lucinda McCrary, Mahulda Anders, Matilda Hart, and Jane Cox. I give to Julia Ann McCrary her husband Adolphus’ cash notes; to Rebecca Mullinax her husband Ervin Mullinax’ cash notes; to Maria Anderson wife of William Anderson, one hundred and fifty dollars in notes on her husband. If my present wife should have an heir or more by me, I desire it or them to be equal heirs with my first wife, Mary Jones’ children. I appoint Assena T. Jones, my wife, of the county of Henderson and State of North Carolina, executrix of this my last will and testament. In witness whereof I have signed and sealed and published and declared this instrument as my last Will and Testament at Hendersonville, Henderson County, North Carolina. This is the year of our Lord One Thousand Eight Hundred and Eighty Five, the eleventh day of June. Solomon Jones The said Solomon Jones of Hendersonville on the eleventh day of June, One Thousand Eight Hundred and Eighty five, signed and sealed this instrument and published and declared the same as and for his last will and we at his request in in his presence and in the presence of each other have hereunto written our names as subscribing witnesses. J. G. Waldrop D. Stradley W. G. B. Morris State of North Carolina – Henderson County} In the Superior Court, May, 1899. The foregoing annexed paper writing purporting to be the last will and testament of Solomon Jones deceased is exhibited before me for probate by Assena T. Jones the executrix therein named and it is duly proven by the oath and examination of J. G. Waldrop, that he is a subscribing witness to said paper writing, that the said Solomon Jones signed the same in his presence, and that he with D. Stradley and W. G. B. Morris witnessed the execution of the same and signed their names thereto as such, that the said W. G. B. Morris is dead and D. Stradley is a nonresident of the State of North Carolina. That at the time of said Solomon Jones’ signing said Will, he was of sound mind and memory, of full age and was not to his knowledge or belief under any restraint. And it is duly proven by the oath and examination of S. W. Hamilton that he is well acquainted with the handwriting of the said Solomon Jones the testator and D. Stradley and W. G. B. Morris the subscribing witnesses thereto, having often seen them write, that the signature of the said Solomon Jones the testator to said Will is in his own handwriting and that the signature of the said D. Stradley and W. G. B. Morris as subscribing witnesses thereto are in their own proper handwritings, that the said D. Stradley is a non-resident of the State of North Carolina and that W. G. B. Morris is dead. It is therefore adjudged that the said paper writing and every part thereof is the Last Will and Testament of the said Solomon Jones deceased. And it is ordered and adjudged that the same be recorded and filed as such and the said Assena T. Jones is duly qualified as Executrix thereof by taking and prescribing to the oath of office prescribed by law and letter. Testamentary are duly issued to her. This the 11th day of May, 1899. W. Pace Clerk of Superior Court Henderson County – In the Superior Court} In the Matter of the Will of Solomon Jones} Before C. M. Pace, Clerk of Superior Court. Assena T. Jones being duly sworn doth say: That Solomon Jones late of said County is dead, having first made and published his last Will and Testament and that she is the executrix named therein. Further that the property of the said Solomon Jones consists of a tract of land containing 160 acres worth about $800, a small amount of household and kitchen furniture is worth about $15.00 so far as can be ascertained at the date of this application; and that she is the party entitled under said will to said property during her lifetime.
