Hertford County, NC - Will of SAMUEL NICHOLSON - 1828 ~~~~~~~~~~~~~~~ Will of SAMUEL NICHOLSON - 1828 In the name of God, Amen, I Samuel Nicholson of the County of Hertford and State of N. Carolina being in perfect health and of a sound mind do make this my last will and testaments follows ****** I give and bequeath to my beloved wife Sally Nicholson all the negroes of which I am now possessed or may hereafter acquire together with all my horses, Cattle, sheep, cows and hogs, who now are on or may be on the plantation on which I now live besides all my household and kitchen furniture, siding chairs and lumber of various kinds, belonging to main plantation items. I give and bequeath to her all the Bonds, notes and books accounts of which I may die possessed of and in fact everything belonging to me in the State of North Carolina. I also bequeath to her during her natural Life the proceeds of a track of Land in the county of Herkimer and State of New York if she thinks proper to receive the same every year or if not my will is that it is to be sold and for her to receive one third of the balance thereof forever the remainder of my property in the State of New York which I now possess or may possess or may hereafter come into the possession of I bequeath that it may be equally divided among the children of my two Sisters Viz Ann Smith and Margaret Rockstower? and my Brother John Nichols al of the State above mentioned In witness whereof I from herewith set my hand and seal the 10th day of March 1817 ~~~~~ Samuel Nicholson {seal} State of North Carolina Hertford County ~~~~ November Court of Pleas 1828. Personally appeared in open Court Elizabeth **** *** being duly sworn according to Law and made oath that the within paper writing was found after the death of Sam Nicholson by her and in the presence of Sally Nicholson among the valuable papers of said deceased. In a ***** where said deceased usually kept these valuable papers and at the same time James Morgan, Jos S. Rea and John Waddill being duty sworn according to law made oath that they ***** believe said paper and every part thereof is in the had writing of Samuel Nicholson deceased, and they further made oath that the signature inscribed there as the name and signature of Samuel Nicholson is a proper handwriting of said Samuel Nicholson, whereupon ordered by the Court that the said will probated be recorded. At the same time Administration with the will ***** was granted to Sally Nicholson who entered into bond as the Law directs. Test. L.M. Cowper, Clk State of North Carolina I Lewis M. Cowper Clerk of the Court of Pleas Quarter Session of Hertford County do hereby certify the annexed? to be true copy from the records of my office, in testimony whereof I have heard Subscribed my name and affixed the seal of my office at Winton this 12th Day of December 1828. State of North Carolina Court of Pleas and Quarter Session Hertford County ~ February Term 1831 Nicholson deceased was exhibited in open Court at the time and the Court being satisfied of the Authenticity of the same the said Copy was ordered to be recorded in presence of an act of assembly for the relief of such persons as suffer from destruction of records of Hertford County occasioned by the burning of the Court House and Clerks office of said County passed at the session of 1830.
