Hertford County, NC - Will of Margaret C. Nicholls, 1838 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God, Amen, I Margaret C. Nicholls, of Bertie County, and State of North Carolina; being in perfect health of body, and of sound and disposing mind, memory and understanding, considering the certainty of death, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world, when it shall please God to call me hence; do therefore make and publish my last will and testament, in manner and form following; that is to say: First and principally, I commit my soul into the hands of Almighty God, and my body to the earth, to be decently buried at the discretion of my Executors hereinafter named, and after my debts and funeral charges are paid, I devise and bequeath as follows; Item. I loan unto my son Frederic M. Capehart of Murfreesboro, for the use, support and maintenance of himself and his family, for and during the times of his natural life, two lots of land in the said town of Murfreesboro, on which there is a dwelling house and other houses at present in the occupancy of him my said son, of which I purchased from Perry Carter; I also lend unto him, said son, in like manner, the following Negro slaves, namely, Lovy, Albert, and Andrew: and at his death, I give, bequeath, and devise said lots and slaves, the Survivor or Survivors of them to be equally divided between the children of my said son, them living, and the issue of such as may have deceased, (said issue representing their deceased parents) forever. Item. I give and bequeath unto my daughter Elizabeth M. Capehart the following Negro slaves and their increase; Maria, Daniel and Edna, to her, and her heirs and assignees forever. Item. I give and bequeath unto my Daughter-in-law Penelope B. Capehart, one feather bed, bed stand and necessa(?) ... my furniture. Item. I give and bequeath all the rest and residual of my property to my son Frederic M. Capehart, and my daughter Elizabeth M. Capehart, to be equally divided between them, their heirs, and assignees. Lastly, I do hereby constitute and appoint my son Frederic M. Capehart, and my friend Charles W. Jacocks executors of this my last will and testament by me made ratifying and confirming this and none other to be my last will and testament ~ In testimony whereof I have hereunto set my hand and affixed my seal, this 3rd day of May in the year of our Lord, One Thousand, Eight Hundred, and Thirty Eight.
