Spiers of the County of Hertford and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly exhistence, do make and ordain the following as my last Will and Testament to wit Item I I give and bequeath unto my grandson Lewis Spiers son of Benjamin A. Spiers, all of my real estate, to him and his heirs in fee simple forever. Item II I give and bequeath unto my grand daughters Ida Norma Spiers and Mrs. Helena Spiers my pair mirros. Item III I give and bequeath my best feather bed and clothing and bedstead to my grand daughter Ida Norma Spiers. Item IV I give and bequeath my clock and window curtains to Mrs. Sarah Spiers wife of Benjamin A. Spiers. Item V It is my will and desire that the remainder of my property of every kind and description, not given away in the above bequests, be sold at public sale and from the proceeds of such sale I wish all my just debts paid and the balance if any I wish equally divided between and given to my four grandsons Stowe, Junius, Lewis, and Benjamin Spiers, sons of Benjamin A. Spiers. I hereby nominate and appoint my beloved son Benjamin A. Spiers Executor of this my last Will and Testament to execute the same according to the true intent and meaning of the same. In testimony whereof and in witness of the same I hereunto set my hand and affix my seal this the Third day of May AD 1871. Susan O. Hines State of North Carolina } In the Probate Court Hertford County } Nov. 5th 1873 A paper purporting to be the last Will and Testament of Susan O. Spiers deceased is exhibited before me, the undersigned Judge of Probate for said County by John T. Lewter and the due execution thereof by the said Susan O. Spiers by the oath and examination of John T. Lewter and A.P. Hines the subscribing witnesses thereto: who being duly sworn, doth depose and say and each for himself deposeth and sayeth, that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Susan O. Spiers, that the said Susan O. Spiers in the presence of this deponent subscribed her name at the end of said paper writing, which is now shown as aforesaid, and which bears date of the Third of May 1871 - And the deponent further saith, That the said Susan O. Spiers the testatrix aforesaid, did at the time of subscribing her name as aforesaid, did on the said paper writing so subscribed by her, and exhibited, to be her last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of the said Testatrix. And this deponent further saith, that at the said time when the said Textratrix subscribed her name to the said last Will as aforesaid and at the time of the deponents subscribing his name as an attesting witness thereto, as aforesaid, the said Testatrix was of sound mind and memory, of full age to execute a Will and was not under any restraint to the knowledge, information or belief of this deponent, and further these deponents say not.
