HIGSON, as joint heirs of Willoughby HIGSON, dec'd., as plaintiffs, and William WATSON and Daniel SHAW, executors of said W. HIGSON, defendants, filed at August Term 1828 and amended at November Term by appointing Daniel SHAW as administrator of Elizabeth S. HIGSON, the Court ordering the accounts to be referred to us, the undersigned commissioners, to examine and make report. Willoughby HIGSON "being in a low state of health" 23 Augt. 1826 at Mattamuskeet / Probate: August Term 1826 I lend my wife Betsy during her life the dwelling and land whereon I now live containing 14 1/4 acres. Also 1/3 the benefit of all my other land for life. I also lend her the use of all my Negroes for the term of two years after proving this will. I give and bequeath unto my wife Betsy all my household & kitchen furniture, beds and bedding, my horse, riding chair and harnesses, farming utensils, 4 cows and calves and for her first year's provision $200.00 and a childs part of all my personal estate when my executors make a division. Daughter: Harriet Wallace HIGSON 100 acres of land which I purchased on Juniper Bay. Son: William Farris HIGSON, at the death of my wife to have the dwelling and land whereon we now live with the store houses and all the lots adjoining. Also 10 acres of land which I purchased of Henry GIBBS on the North side of the Lake adjoining Joseph MASTERS. I give and bequeath unto the child my wife is now pregnant with 48 acres of land undivided in Currituck and which is termed maiden land. All my perishable estate not already allotted I wish to be sold on a credit of 6 months and at the end of 2 years from proving this will, I wish a division of my Negroes and all my personal estate to be made between my wife and children, share and share alike, except the child my wife is now pregnant with I wish to have $100.00 more. Also I wish when a division is made that suitable guardians be appointed for my children and each child's share be paid to its guardian. I wish my executors to have built as soon as practicable out of good material a barn 22' long and 16' wide, a single story, and place it a suitable distance from my dwelling, the expenses of which will be chargeable to my estate.
