Hugh JONES "being in good health" 19 November 1824 / Recorded: November Term 1826 I will and direct that all my Negroes which I may own at my death and all such as may be purchased by my executors may be kept on my plantations to work and labor until my youngest child shall attain the age of 20. I direct that a good overseer be hired to superintend my plantations and Negroes. I direct that my Negroes, after making the crops, be employed in clearing such lands and cutting canals or ditches. After the discharge of my debts all surplus income shall be applied by my executors to the purchase of young Negroes between the ages of 10 & 21 of both sexes. I will that no division of my estate take place until my youngest child attains the age of 20, at which time I will that my property be divided in the following manner: * Eldest daughter: Eliza Williams JONES I give the plantation on which I now live known by the name of the Lake Landing plantation, together with the mill and the land I bought on the Lake between Lake Landing and the land now owned by Capt. David WALLACE. As this is the most valuable part of my estate, in order to equalize it, I will that it be taxed to pay $1000.00 to each of my other daughters in the following manner: + $1000.00 to Frances at the expiration of the 1st year + $1000.00 to Julia at the expiration of the 2nd year + $1000.00 to Harriet at the expiration of the 3rd year + $1000.00 to Ann at the expiration of the 4th year * Daughter: Julia I give my plantation at the head of Wysockin known by the name of Egypt and also 300 acres adjoining the same tract of back land which Frances receives. * Daughter: Harriet I give my plantation on the North side of Mattamuskeet Lake adjoining the land of Lemuel CARTWRIGHT. I also give her 1/2 of three 600 acre tracts situated partly behind Fort Point. * Daughter: Ann I give my plantation on the Lake at the Rose Bay Turnpike. I also give her the other 1/2 of the three 600 acre tracts from which Harriet receives hers. I will that when my youngest daughter shall attain the age of 20, my Negroes, plantation tools and stock of all kinds be equally divided between my children. If I die before I cut a canal 10' wide and 2' deep from Alligator River to the land devised to my daughters, Harriet and Ann, on the North side of Mattamuskeet Lake and another from Lightwood Creek Bridge, a direct course to the line between the lands of John G. BLOUNT, PALMER tract, and myself, I will that my hands be occupied all the spare time in cutting first the Canal from Lightwood Creek Bridge and then from Alligator River. When it is too wet, the Negroes shall cut down and clean up 200 acres of the lands devised to Ann, then immediately proceed to clean up 200 acres devised to Harriet. If either of my daughters should die without lawful issue then the lands shall be equally divided among the surviving children. If all my children should die without issue, then the whole of my property to go to my brother, Richard B. JONES, with the exception of $2000.00 to be given to my brother-in-law, John W. GUION? I direct that all my cleared lands not cultivated be hired out to good and trusty tenants. Also the uncleared lands be hired out. I will and direct that my children be removed as soon as possible to the state of Pennsylvania to my father's or brother's and there educated and shall by no means or any pretext be bought back to North Carolina before they are 20 years of age. If either of my daughters marry before the age of 20 then the lands and every species of property heretofore devised to her will be forfeited with the exception of $100.00 to be paid to her. I will and direct that the house and lot in New Bern, formerly the property of Dr. Andrew SCOTT, which I purchased at Sheriff's sale, shall be sold and the proceeds applied to extinguishing my debts. Daughter: Eliza W. JONES shall be entitled to all the wood to be taken off of the tract of 300 acres bequeathed to Frances lying west of EVANS' land and south of the CARROWON land. I further will that my Negro man George and his wife Grace, if alive at the division of my Negroes, with all the children they now have, shall be given to Eliza and charged to her at a fair valuation as her share, or part of her share of Negroes. I also give her all my books not on professional subjects. And I further will that the professional books be sold or exchanged for historical works and that my instruments and shop furniture be sold and applied in the same way for the use of Eliza. I will that all my household furniture be sold on a credit of 6 months with the exception of my writing chair and bookcase which I give to Eliza. Executors: brother Richard B. JONES, John W. Hosea TYSON "of the County of Beaufort" 14 October 1827 / Probate: November Term 1831 * Wife: Fanny TYSON I give and bequeath 3 Negro men named Hose?, York, and Jack. Also all my household and kitchen furniture as well as that at my plantation in Hyde whereon I live. Also 50 barrels of corn, all my hogs and potatoes, 10 cows and calves, her choice of 2 beef steers, 15 head of sheep, my riding mare, wheat on hand, all farming tools, gun boat, harness and horse cart.
