I JACOB BASTIAN of the County of Iredell and State of North Carolina, being of a sound and perfect mind and memory ( Blessed be God) do this 16 day of February in the year of our Lord one thousand Eight Hundred and thirty-eight, make, constitute and publish this my Last Will and Testament in the manner following Viz: First, I give and bequeath to my beloved Wife CATHERINE, during her natural life times my plantation whereon I now live containing 364 Acres and my negro boy, Solomon and negro woman named Judi with her present increase, and two plow beasts, her choice and all my stock of every sort and all my ____ household and kitchen furniture and farming utensils and my waggons and ___ and ____. Second I give and bequeath to my beloved Daughter ELIZABETH MINGUS, my negro boy, Jack, to her and after her to her children and the lower part of my plantation mentioned in the first clause of this my Will, beginning on the upper end and on line of said plantation and running nearly a south course including my Dwelling house and my kitchen, and thence through the floor of my barn, leaving the east end to my daughter ELIZABETH, then on a straight course to the River, and my negro woman named Judi mentioned in the first clause of my Will after her mother's death with her future increase not mentioned in this Will to her and after her death to her children. Third I give and bequeath to my Grandson DAVID BASTIAN, the west part of my plantation mentioned in the first clause of this my Will; Beginning on the upper end and line before mentioned and running the same course and distance mentioned in the second clause of this my Will to the River, leaving the west end of my barn to said DAVID including the house wherein he now lives and the kitchen and garden near said house and my negro man named Peter to him and his heirs, and I give to his wife SUSANNA my negro girl named Betsy to her and after her death to her children, Fourth, I give and bequeath to my Granddaughter, CATHERINE LITTLE, my negro boy Daniel and negro boy named Jack, after his Grandmother's death to her and after her death to her children. Fifth, I give and bequeath to my Granddaughter ELIZABETH LITTLE my negro boy, Levi and negro girl named Mary. Sixth, I give and bequeath to my Granddaughter ELIZABETH BENFIELD my negro boy named Milas (?) to her and after her death to her children. Seventh, I give and bequeath to my Granddaughter CAROLINE LIPPARD my negro girl named Caty to her and after her death to her children with her increase. Eighth, I give and bequeath to my Grandson ANDREW MINGUS my negro boy named Abram to him and his heirs. Ninth I give and bequeath to my Brother MICHAEL BASTIAN my negro woman named Peggy to him and his heirs. Tenth I give and bequeath to my sister PENNA (?) FREEZE, my negro girl named _____ to her and after her death to her children. Eleventh I give and bequeath to my sister CATHERINE COPE my negro girl named Sally and after her death to her son, JACOB COPE with her increase. Twelfth I give and bequeath to my nephew JACOB BASTIAN SENR., my negro boy named Thomas and my negro girl named Polly and her increase to him and his heirs, and my German Bible. Thirteenth I give and bequeath to my daughter ELIZABETH MINGUS, my negro man Solomon and my negro woman named Susan and her two children named Ambrasie and Dana, but my will is that my wife shall have full possession of them until her death and then they shall be my daughter's to her and after her death her children. Fourteenth I give and bequeath to my granddaughter MIRA STIREWALT my tract of land containing 200 acres less or more adjoining Lansford and others to her and after her death to her children. Fifteenth I give and bequeath to my nephew JOHN BASTIAN my negro boy named George to him and his heirs. Sixteenth, my will is that my daughter ELIZABETH MINGUS is to have Judi's youngest child, not yet named with future increase to her and after her death to her children. Seventeenth, my will is that all my property not mentioned in this Will, or such as my Wife does not deem necessary to hold, is to be sold and the money arising from this sale is to be equally divided between my wife Catherine and my daughter ELIZABETH MINGUS and daughter POLLY GRAHAM'S children. Lastly, I ordain and appoint my nephew JACOB BASTIAN, SENR. And my son-in-law CONRAD MINGUS executors of this my Last Will and Testament. In witness whereof...I the said JACOB BASTIAN SENR. Shall to this my Last Will and Testament, set my hand and seal this day and year above written. Test. Theophilus Falls William Momson (?) Signed, Sealed and Published and declared by the said JACOB BASTIAN the testator as his Last Will and Testament in the presence of us. ****************************************************************** First Codicil to the Will of JACOB BASTIAN JACOB BASTIAN of the County of Iredell and State of North Carolina do this the thirty first day of August, one thousand Eight hundred forty four, make and publish this Codicil to my Last Will and Testament in manner following that is to say: First I give and bequeath to JOSIAH BASTIAN, son of my nephew, JACOB BASTIAN, of the County of Iredell, one negro boy named Miles which is now in the possession of the said JOSIAH, forever. Second, I give and bequeath to SUSANNA BASTIAN, wife of my grandson, DAVID BASTIAN, one negro girl named Betsy and after her death to her daughter REBECCA. Third, I give and bequeath unto my Granddaughter ELIZABETH LITTLE, one negro boy named Levi and one negro girl named Mary and her increase to her during her lifetime and after her death to her children. Fourth, I give and bequeath unto my beloved brother, MICHAEL BASTIAN, one negro girl named Peggy and her increase forever. Fifth, I give and bequeath unto my beloved sister PENNA(?) FREEZE one negro girl named Penna(?) and her increase and after her death to her children forever. Sixth, I give and bequeath unto my beloved daughter ELIZABETH MINGUS, one negro boy named Solomon and one negro girl named Susan and her increase and after her death to her children, and also I bequeath unto her one negro woman named Judi and her increase since the date of my above Will, and after her death to her children. And lastly, it is my desire that this codicil be annexed and made a part of my Last Will and Testament, to all intents and purposes in Witness whereof I have set my hand and seal this the thirty first day of August one thousand Eight hundred and fourty-four and Signed, Sealed and delivered in presence of J. H. Alexander Theophilis Falls Second Codicil of JACOB BASTIAN I, JACOB BASTIAN of the County of Iredell and State of North Carolina having made and published my Last Will and Testament and having omitted to dispose of all the increase of my Negroes and being desirous to dispose of the same by bequest do this 2nd day of September One thousand Eight hundred and forty four make and publish this second codicil to my Last Will and Testament in manner following: First I give and bequeath unto my granddaughter ELIZABETH LITTLE during her life and at her death to her children, one negro boy named Levi and one negro woman named Mary and all her children born since the annexed Will was made, and all her future increase. Secondly, I give and bequeath unto my brother, MICHAEL BASTIAN, one negro woman named Peggy and all her children born since the making of the annexed Will, and her future increase. Thirdly, I give and bequeath unto my sister PENNA FREEZE during her life, at her death to her children, one negro woman named Penna, and all her children born since the making of the annexed Will , and her future increase. Fourthly, I give and bequeath unto my daughter ELIZABETH MINGUS during her life and at her death to her children one negro boy named Solomon and one negro girl named Susan and all her children born since the date of the annexed Will and all her future increase. And lastly, it is my desire that this codicil be annexed to and made a part of my Will and Testament to all intents and purposes. In witness whereof I have hereunto set my hand and seal this day and date above mentioned. Signed, Sealed and Published in the presence of John Stafford Peter X Dagenhart Third Codicil to Will of JACOB BASTIAN JACOB BASTIAN of the County of Iredell State of North Carolina having made and published my Last Will and Testament and being desirous, remove my son-in- law, CONRAD MINGUS from the executorship as mentioned in the annexed Will and appoint some other suitable person in his room and stead of this said MINGUS, do publish this third codicil to my Last Will and Testament and desire that this codicil be annexed and made a part of my Last Will and Testament to all intents and purposes and that I do nominate and appoint my beloved and trusty friend and grandson, DAVID BASTIAN coexecutor with my friend JACOB BASTIAN mentioned in the annexed Will in the room and stead of the aforesaid CONRAD MINGUS, in witness whereof I have this the sixth day of April One thousand Eight hundred and Forty six have set my hand and seal and do publish and declare this to be a part of my Last Will and Testament, in presence of Theophilis Falls W.
