NC Submitted by: Carol Smith Source:  Johnston County, NC Estate Records, 1823-1825 Daniel Averyt, 1822, p. 4   To the Worshipfull the Justices of the County Court of Johnston   The undersigned required by your order to lay off and allot to Simon Averyt, Jonathan Averyt, Harry (Henry) Averyt, James Averyt, Samuel Averyt, Winefred Vinson, Aaron Averyt, Eliza Averyt, Edith Averyt, William Averyt, Patience Averyt, Alfred Averyt and the Widow their distributive Shair of the negroes belonging to the Estate of Daniel Averyt, deceased.   Report:  That we proceeded to value the negroes belonging to the Estate of said deceased at his death, as follows:   Penny $350.  As $525.  Cain $475. Abel $475.  Lucy $375.  Berry $325. Willis $320.  Mary $175. Jebler $....Hannah $.... and that there was four negroes that had been given off before the death of the said deceased (to wit) Chany to Jonathan Averyt, valued $325.  Rildy to Harry (Henry) Averyt $275.  Crecy to Winefred Vinson at $225. and Alley to Simon Averyt at $200.- and that the said Heirs gave in  on oath that they have received before the death of the said deceased the following Sums respectively (to wit, Jonathan Averyt $429 worth of property Including negroe Chany, Harry Averyt received $369 worth property including negro Ridley, James Averyt received $50 worth of property, Samuel Averyt rec'd $361 worth property, Winefred Vinsent rec'd $270.50 worth of property, Aaron Averyt rec'd $7.75 worth of property.  Eliza Averyt rec'd $13 worth of property.  Alfred Averyt rec'd $20 worth of property, and the said Alfred Averyt being in debt considerably to the Estate consented not to come in for any part of Share of the aforesaid negroes except the two Jebler & Hanna which were not valued to anything and was given up to ?heir? by consent of all parties, and it appearing to the commity by testimony on oath that Simon Averyt had rec'd before the death of said deceased. Land, and other property to the amt of $780 and he not claiming any thing more, he was not considered as entitled to any part of Shairs in the aforesaid Negroes.  And after adding the valluation of the aforesaid Negroes and the property recd by the different Heirs, Simon Averyt excepted, We find that there is the Sum of $4,540.25 which being divided between twelve Heirs including the Widow, We find that there is the Sum at $378.35 to a Shair and the aforesaid Jonathan Averyt, Harry (Henry) Averyt, Winefred Vinson and Samuel Averyt being contented with what they had recd except their part or Shair of the said deceased.  Lands, consented that we Should make a division among the other named Heirs (To Wit) James Averyt, Aaron Averyt, Eliza Averyt, Edith Averyt, William Averyt, Patience Averyt and the Widow of the said deceased and that we then proceeded to draw the Negroes for the aforesaid Heirs (to wit) Eliza Averty drew Lucy which was valued at $375, being $3.35 less than her distributive part or Shair, Patience Averyt Widow of said deceased drew Asa Valued at $525, which left her in debt $146.65.  William Averyt drew Abel which was valued at $475, being $96.65 more than his distributive Shair.  James Averyt drew Willis & Mary, WIllis being valued at $320 and Mary at $175, being $116.65 more than his distributive Shair.  Edith Averyt drew Berry valued at $325, being $53.35 less than her distributive Shair.  Patience Averyt drew Penny valued to $350, being $28.75 less than her distributive Shair.  Aaron Averyt drew Cain valued at $475, being $96.65 more than his distributive Shair all of which is submitted, given under our hands & seals December 11, 1822.  Signed by R.
