All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Guy Potts http://www.genrecords.net/emailregistry/vols/00017.html#0004214 April 9, 2018, 9:32 pm Source: Familysearch.org Written: 1858 John Eldridge State of North Carolina, Johnston County Court of Pleas and Quarter Sessions Feby Term 1858 To the worshipful the Justices of said court; The petition of Elizabeth Eldridge widow of John Eldridge respectfully showeth unto your worships that her said husband died intestate in the year 1850 in Johnston County leaving heirs surviving the following children, to wit, Troy Eldridge Loverd Eldridge Susan wife of John A Layton Pherebee wife of Joseph Westbrook Ann wife of Young J Lee Betsey Eldridge Emily Eldridge William Eldridge John Eldridge Katharine Eldridge who are his only heirs at law the three last of whom are infants represented by their guardian Troy Eldridge. Your petitioner further showeth that at the time of her said husbands death he was seized in fee simple of a tract of land in said county adjoining the lands of John Eldridge Sr, Whitfield Tart and others containing by estimation about three hundred acres. Your petitioner further showeth that she desires to have her dower in the said land allotted to her and to that and she prays your worships to order a writ to be directed to the Sheriff commanding him to summon twelve freeholders connected with the parties neither by consanguinity or affinity, to view the aforesaid tract of land and to allot and to set apart to her one third part thereof including the dwelling house and all out houses, buildings and improvements appertaining to the same for the term of her natural life and to report their proceedings in due form of law. May it please your worships to order subpoenas with copies of this petition to be issued to the said heirs at law requiring them to appear at the next term of court and show cause if any they can why the prayer of your petitioner shall not be granted and your petitioner as in duty bound will ever pray.
