Johnston County, NC - Blackman & Mary Lee to Franklin & John Hooks, 1848 ~~~~~~~~~~~~~~~~~~~~~~~~~~ (Copy of Deed) A This Indenture made the 8th day of February in the year of our Lord one thousand eight hundred & forty eight between Blackman Lee & his wife Mary Lee who was Mary Fellow, of the County of Johnston in the State of North Carolina of the one part & Franklin H. Hooks of the County of Wayne & State aforesaid, of the other part, Witnesseth that the said Blackman Lee & wife Mary Lee, formally Hooks, who was originally Mary Fellow, for & in consideration of the natural love and affection which they have & bear unto Franklin H. Hooks, and also for & in consideration of the sum of five dollars to them in hand paid by the said Franklin H. Hooks at & before the sealing & delivering of these presents the receipt whereof they do hereby acknowledge, have granted, bargained, sold, nemised, released & confirmed and so by these presents, give, grant, bargain, sell, demise, release & confirm unto the said Franklin H. Hooks, all that tract or parcel of land situated lying & being in the County of Sampson State of North Carolina in the fork of Great Coherra & Ward Swamps, and part of Coharra Swamp & bounded as follows, Beginning at a small sweet gum at the run of Ward's Swamp opposite the mouth of the Sam Marsh Branch then of the marsh the various courses to the head of the middle prong of said marsh, thence North 18 W 70 poles to a lighwood stump, thence No 1 W 54 poles to a maple in a pond in the back line, thence with bank on old line So 88 W 162 poles to a water oak in the edge of a pond, thence So 40 W 390 poles to a water oak at the run of Great Coherra, thence up the run of the same as it meanders 60 poles to a gum on the edge of the same, thence So 74 W 72 poles to a stake, thence So 24 E 60 poles to a red oak Henry Holland corner, on this side of the swamp, thence along the edge of the swamp with said line So 38 W 42 poles to his corner line, thence with his line So 63 E 114 poles to a line by the run of Cohary, thence So 81 E 116 poles to a holly at the run of Ward's Swamp, thence up the run as it meanders to the first station containing eight hundred & seventy two acres it being the land alloted to Mary Fellow by order of the Superior Court of Fayetteville issued or made at October term 1801 being lot No. 3 To have & to hold the said land with it appurtenances, to the only proper use behoof & benefit of the said Franklin H. Hooks, his heirs & assigns forever, and we Blackman Lee & his wife Mary Lee for themselves their heirs executors & administrators, doth covenant, promise and agree to & with the said Franklin H. Hooks his heirs & assigns, that the said Franklin H. Hooks his heirs & assigns and every of them, shall hold, occupy, possess & enjoy the said land with its appurtenances to and after the death of Mary Lee, a life estate in said land being reserved to & for the use and benefit of Mary Lee, and further free from the claim or claims of any person or persons whatever, hereby warranting & defending all the interest rights & title which they have in & to said land, the life estate of Mary Lee being reserved, unto the said Franklin H. Moore Regr (Copy B) This Indenture made this 21st day of March in the year of our Lord one thousand eight hundred & forty eight, between Blackman Lee & his wife Mary Lee of the County of Johnston & State of North Carolina of the first part and John Hooks son of Mary Lee of the County of Wayne & State aforesaid of the second part Witnesseth that the said Blackman Lee and Mary Lee for and in consideration of the sum of five dollars also for the further consideration of the natural love and affection which the said Blackman Lee & his wife Mary who was Mary Hooks & is the mother of John Hooks, hath and leaveth unto the said John Hooks, as also for the better preferment & mantainance of the said John Hooks, have given, granted & confirmed and by these presents doth give, grant, & confirm, unto the said John Hooks, his heirs and assigns, all that piece tract or parcel of land, situated lying & being in the County of Johnston it being a part of the land formerly owned by William Williams & known as the Williams land, bounded as follows, Beginning at a white oak runs South 64 West 24 poles to a gum, then South 260 poles to a hickory, then South 15 East 46 poles to a white oak, then South 40 Et 21 poles to a stump, then South 8 West 41 poles to a small gum near the road, then South 76 E 24 poles to a white oak, then South 5 Et 26 poles to a mulberry, then South 18 West 34 p, then South 28 West 34 poles to a stake then South 22 E 172 p. to a pine, then South 68 West 26 poles, then South 24 West 18 poles to a maple in the head of the branch, Nehemiah Blackman's corner, then down the meanders of said branch to a small white oak in Bushes branch, then up the said branch to Banzilla Blackman's line No 33 West 54 poles, then South 58 W 10 poles, then No 33 1/2 West 200 poles to a white oak, then No 65 W 41 p. to a stake near Steven's branch, then N 36 E 51 poles to a white oak, then South 65 E 80 poles to a black jack, then No 27 E 160 poles to a stake, then No 77 W 106 poles to the run of said Steven's branch, then down the meanders of said branch to the run of Bushes Creek, then down the meanders of said Creek to the beginning containing seven hundred & eleven acres, Also one other tract beginning at a stake the said Susannah Blackman's corner, running thence No 77 West 111 poles to a red oak Joab Blackman's corner in Steven's branch, then up said branch with said Blackmans line So 37 W 120 poles to a corner then So 94 poles to a stake, then So 32 E 39 p to a stake, then a straight line to the first station containing ninety six acres more or less, which said land was conveyed February 21st 1829 by Susannah Blackman to Mary Hooks then of the County of Wayne, which said deed was registered May 24th 1829 in Johnston County; also one other tract of land in Johnston County, known by the name of narrow gap, on the south side of Mill Creek & northwest side of Bushes Swamp, adjoining the lands of Mary Hooks on the east, Nathan Altman on the South, Banzilla Blackman on the west & William Eldridge on the North, Beginning at a pine in the dividing line between John Eason and said Eldridge, then with said line No 51 E 194 yards or thereabouts to a corner pine in said Hook's line, then South 32 E with said line to the run of said Banzilla Blackman's mill branch, then up the various courses of said branch, to the mouth of a small branch a few yards above said Blackman's Mill dam, thence the various courses of said branch to the mouth of a small branch a few yards above said Blackman's mill dam, thence the various courses of said branch, crossing the road to a red oak about two hundred & fifty yards distance from said road, thence a straight line to the beginning containing thirty acres more or less, which said land was conveyed Decmbr 10th 1832 by John Eason to Mary Hooks, registered April 25th 1834; To have and to hold the above described lands together with the appurtenances thereto, unto the said John Hooks his heirs & assigns to the use & behoof of him Outside jacket reads: John J Hooks et al vs Blackman W Lee Filed July 7 1850 In Equity from Wayne Appeal to the Superior Court Transcript of Record &c Recorded Dec Term 1850 Wayne Source: Supreme Court Case #6491 John J.
