Johnston County, NC - Jeremiah Fail to Benjamin Rose, Jr., 1824 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Johnston County Deed Book Z #2, pg 334 - 135 acres From the Wycliff Rose Papers at the Heritage Center, Smithfield, NC This Indenture made this 23rd day of February, in the year of our Lord one thousand eight hundred and thirty three between Jeremiah Fail of the State of North Carolina and County of Johnston of the one part and Benjamin Rose, Jr., of the same State and County aforesaid of the other part, Witnesseth: that the said Jeremiah Fail for and in consideration of the sum of one hundred and ten dollars to him in hand paid at and before the signing and sealing of these presents, the receipt and payment whereof is hereby acknowledged, that I am therewith fully satisfied, contented and paid have given, granted, bargained, aliened, and sold unto him the said Benjamin Rose, Jr., his heirs and assigns forever, a certain piece or parcel of land situate, lying and being in the aforesaid state and county on the south side of Mill Creek and on the west side of the Wise Branch, beginning at the run of the Wise Branch where John Stevens line crosses said branch and runs his line N 70 W 30 poles to a pine, Sarah Walker Branch, his corner, thence his line crossing said branch N 30 E 22 poles to a stake, thence S 80.26 poles to John Stevens other line; thence his line S 30 W 66 poles crossing Sarah Walker Branch to a small poplar in a branch his corner; thence his line W 170 poles to a small post oak; thence S 130 poles to a pine by the path, Henry Stevens corner; thence his line N 66 E 17 poles to a small black jack; thence N 18 W 4 poles to a black jack (down) said Stevens corner near the head of Sarah Walker Branch; thence his line 72 E 208 poles to a red oak, (down) his corner; thence S 18 E 7 poles to a small branch; thence down the meanders of said branch to the Wise branch; thence down the meanders of the Wise Branch to the beginning containing one hundred and thirty five acres more or less, being part of a tract of land granted to Nathan Atkinson for 300 acres To have and to hold the aforesaid land and premises with all and singular the priviledges, profits, benefits, and appurtenances thereunto belonging or in any wise appertaining unto him the said Benjamin Rose, his heirs and assigns forever.
