Johnston County, NC - Joseph Langston, Sr. to Benjamin Rose, Jr., 1803 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Johnston County Deed Book C #2, pg 83 - 111 1/2 acres From the Wycliff Rose Papers at the Heritage Center, Smithfield, NC This Indenture made this the 27th day of June in the year of our Lord one thousand and eight hundred and three between Joseph Langston, Sr. of the state of North Carolina and county of Johnston, of the one part, and Benjamin Rose of the county and state aforesaid of the other part, Witnesseth: that for and in consideration of the sum of one hundred and thirty nine pounds seven shillings and six pence specie to the said Joseph Langston Senior in hand paid or secured to be paid by the said Benjamin Rose before the insealing and delivery of these presents, the receipt whereof he doth hereby acknowledge himself therewith fully satisfied contented and paid and of every part and parcel thereof, do exonerate, requit and discharge the said Benjamin Rose his heirs and assigns forever have given granted bargained sold conveyed and confirmed unto the said Benjamin Rose his heirs and assigns forever a certain tract or parcel of land situate lying and being in the county and state aforesaid on the north side of the south prong of Mill Creek beginning at a sweet gum on the north side of said creek in a line patent by John Stevens and runs thence with said line north seventy degrees west 88 poles to the corner on a post oak, the beginning corner of said patent; thence with the other line north seventeen degrees east one hundred and fifty six poles to the other corner; thence with his other line east one hundred and twelve poles to the run of said creek; thence up the meanders of said creek to the beginning, containing one hundred and eleven and a half acres, be the same more or less. To have and to hold the above bargained and demised premises with all the appurtenances to the same belonging or in any ways appertaining to him the said Benjamin Rose, his heirs and assigns forever, to his and their only proper use and behoof forever, and furthermore that the said Benjamin Rose, his heirs and assigns shall and may from time to time and at all times, forever hereafter by force and virtue of these presents have, hold and occupy possess and enjoy the said demised and bargained premises with all the appurtenances as free and clear and truly and clearly acquited and discharged from all manner of incumbrances whatsoever, and furthermore, I the said Joseph Langston, Senior, for myself and my heirs, executors and administrators, do covenant and ingage to and with the said Benjamin Rose, his heirs and assigns, executors and administrators to warrant, secure and forever defend the above bargained and demised premises to him the said Benjamin Rose, his heirs and assigns forever, against the lawful claim or demand of any person or persons whatsoever In witness whereof, I have hereunto set my hand and seal the day and year first above written Signed, sealed delivered Joseph (his x mark) Langston {Seal} in the presence of us Samuel Lee, Jr. James Rose State of North Carolina Johnston County November Term 1803 Then was the execution of this deed duly proven in open court by the oath of Samuel Lee, Jr., and ordered to be registered. ___________________________________________________________________ Copyright.
