Rose and William N. Rose both of Johnston, whereas the said B. B. Rose is desirous to make provisions for his children against future contingences and is desirous that certain of his said children should enjoy the proceeds and income of certain real and personal estate hereinafter more particularly described: Now therefore this indenture witnesseth that the said B. B. Rose in consideration of the premises and of the sum of one dollar to him in hand paid by the said party of the second part the receipt whereof is hereby acknowledged, bargained, sold, aliened, conveyed and confirmed and by these presents doth bargain, sell, alien, convey and confirm unto the said party of the second part all that parcel of land lying in the county and state aforesaid on the north side of Mill Creek adjoining the lands of B. Holland and others and contains 292 acres. Also all my personal property of every kind whatsoever together with all and singular the tenements hereditaments and appurtenances thereunto belonging or in any wise appertaining; and also all the estate, right, title, interest, property, possession claims and demands whatsoever as well at law as in equity of the said party of the second part. To Have and to Hold all and singular the above mentioned and described property together with the appurtenances unto the said Wm. N. Rose his successors and assigns. In Trust and to and for the several uses, intents and purposes hereinafter mentioned namely: First: To lease or rent and take the management and control of the above mentioned property and pay all taxes and charges that may be imposed. Secondly: In Trust to convey the said land and premises after my decease and on attaining their majority to my sons B. F. Rose, Thos. W. Rose, Charles M. Rose and Elbert P. Rose and to divide the same equally between them giving Elbert P. Rose the lot on which my house stands. Thirdly: In Trust to convey to my two daughters Emily W. Rose and Julia A. Rose one bed apiece with bedstead and necessary bed clothing and all my household and kitchen furniture. Fourthly: In Trust to convey to my sons, Thos. W. Rose, Charles M. Rose and Elbert P. Rose one horse apiece that may be possessed by me at the time of my decease. Fifthly: In Trust to sell the balance of my property of every kind whatsoever and divide the proceeds of the sale equally between my daughters Sarah E. West, Mary E. Britt, Martha A. Lee, Emily W. Rose and Julia A. Rose. And the said party of the second part doth hereby signify his acceptance of this trust and doth hereby covenant and agree to and with the said party of the first part faithfully to discharge and execute the same according to the true intent and meaning of these presents. In Witness whereof I have hereunto set my hand and seal the day and date first above written. Signed sealed and delivered in the presence of E. A. Bizzell and Henry Langston. North Carolina, Johnston County, In the Probate Court On this the 31st day of March 1874, the due execution of the foregoing Deed is proven before me by Henry Langston one the subscribing witnesses thereunto.
