Brown Regent Recorded on Roll of Pensioners under act February 2, 1848 Page 219 Vol. 1 State of North Carolina Johnston County On this 12th day of January 1847 personally appeared before the subscriber and of the acting Justices of the Peace for said County Durham Lee aged about 60 years who having been duly sworn according to law deposes and says that he has been acquainted with James Lee husband of Elizabeth Lee (for all his life) who is now applying for a Pension. That he has often heard him speak of serving in the war of the Revolution and that the history of the neighbor hood gave him the character of a soldier long before pensions were known here. Durham Lee His mark Sworn to and subscribed before me the day and date above written. B. Blackmon JP I Barzillia Blackmon one of the acting Justices of the Peace in and for said county certify that I am well acquainted with Durham Lee who has been sworn and subscribed the foregoing affidavit and that he is a man of truth and responsibility and that his said affidavit may be relied upon as such. I further certify that I was well acquainted with the said James Lee whose widow Elizabeth Lee is now applying for a pension and that she is the identical widow. ********************************************** Declaration In order to obtain the benefit of the Act of Congress of the 7th July 1838 and of March the 3rd 1843 and of June 17th 1844. State of North Carolina Johnston County On this the 25th day of June 1845 personally appeared before me Barzillia Blackmon one of the acting Justices of the Peace in and for the said County of Johnston Mrs. Elizabeth Lee resident of the aforesaid County aged 80 years She Being first duly sworn according to law doth on her oath make the following declarations in order to obtain the benefits of the pension made by the Acts of Congress of July 7, 1838 and of March 3rd 1843 and of June 17th 1844 That she is the widow of the late James Lee who was a private soldier under Captain Raiford for (18) Eighteen months and ____ ____ she has reason to believe and does believe served out the said Eighteen months faithfully in the war of the Revolution That she is not able to tell what Regiment her said husband belonged to or the date in which the said service was performed. That his discharge is lost. She further declares that she was married to the said James Lee on the 7th day of July Seventeen hundred eighty five (1785). That her husband the aforesaid James Lee died on the 15 day of September eighteen hundred thirty five (1835). That she was not married to him prior to his joining the service but the marriage took place previous to the 1st day of January (1794) seventeen hundred ninety four day at the time above stated. Sworn to and subscribed on the day and year above written Barzillia Blackmon JP Elizabeth Lee I Barzillia Blackmon one of the Justices of the Peace for the County of Johnston do hereby certify that Elizabeth Lee is a woman of truth and responsibility that her statement may be relied upon as such. I also certify that from age and bodily affliction she is not able to attend this court to make her said declaration. And I further certify that she is the identical widow of James Lee Dec.d who was held and reported in his neighborhood of having been a private in the war of the Revolution and that she is still the widow of the said James Lee given under my hand on the 25th day of June 1845. Governor Captain General commander in chief of the State afforesaid in the just and full sum of five hundred pounds current money of the State afforesaid to be paid to his said Excellency the Governor his sucessors or assigns to which payment will and truly to be made and done We bind ourselves our heirs Executors Administrators and assigns jointly and severally firmly by these presents sealed with our seals and dated this the 6th day of July Auno Domini 1785 one thousand seven hundred and eighty five The condition of the obligation is such that wheras the above bounder James Lee hath made application for a license for a marriage to be celebrated between him and Elizabeth Rains of the County afforesaid. Now in case it shall not appear hereafter that there is any lawful cause to obstruct the said marriage then the above obligation to be paid; otherwise to remain in full fare & virtue. Robinett 213 Rule Building Amarillo Texas Dear Sir: The data which follow were obtained from papers on file in the Revolutionary War pension claim W.4013 base upon the military service of James Lee. The date and place of his birth and the names of his parents were not given. He enlisted in 1782, place not stated, and served eighteen months as private in Captain Raiford’s Company in the Tenth North Carolina Regiment. James Lee married in North Carolina July 7, 1785, Elizabeth Raines of Johnston County, North Carolina. He died September 15, 1835. On account of his services in the Revolution, his widow, Elizabeth was allowed pension on her application executed June 25, 1845, at which time she was eighty years of age and was living in Johnston County, North Carolina. One Stephen Lee signed the marriage bond with the soldier, James Lee, in 1785, in 1846 Edward Lee was living, and in 1847 one Durham Lee aged about sixty years and one Ambrose Lee were living but their relationship to the soldier was not shown.
