Devised December 31, 1875, Probated August 31, 1883. In the name of God Amen, I Alvin Coats of the County of Johnston and State of North Carolina being of sound mind and memory, but considering the uncertainty of this frail and transitory life do make ordain, publish and declare this paper writing to be my last Will and Testament, that is to say, First - After all my just debts are paid, the residue of my estate I dispose of as follows: Item: I give and bequeath to my beloved wife Susan all my personal estate, consisting of one sound horse, One buggy, all my Cattle, hogs &c. All my farming utensils, household and Kitchen furniture, and all other articles of personal property, including all notes and accounts due me to her and her heirs forever. And I do hereby Constitute and appoint my trusty friend and brother John R. Coats my lawful Executor to all intents and purposes to Execute this my last Will and testament, according to the true intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring utterly void all other Wills and testaments by me heretofore made. In witness whereof I the said Alvin Coats do hereunto set my hand and seal, this 31st day of December A.D. 1875. Alvin Coats (Seal) Signed Sealed published and declared by the said Alvin Coats to be his last will and testament in the presence of us, who at his request, and in his presence do subscribe our names as witnesses thereto. Parrish State of North Carolina Johnston County - In the Probate Court A paper purporting to be the last will and Testament of Alvin Coats deceased, is exhibited before me the undersigned, Judge of Probate for said County by John R. Coats the Executor therein named and the due execution thereof by the said Alvin Coats by the oath and examination of P. T. Massey and J. H. Parrish the subscribing witnesses thereto, who being duly sworn, doth depose and say, and each for himself deposeth and sayeth, that he is a subscribing witness to the paper writing now shown him purporting to be the last will and Testament of Alvin Coats. That the said Alvin Coats in the presence of this deponent subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date of the 31st day of December 1875. And the deponent further saith that the said Alvin Coats the testator aforesaid did at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited to be his last Will and Testament. And this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last will as aforesaid, and at the time of the deponent subscribing his name as an attesting witness thereto as aforesaid, the said Alvin Coats was of sound mind and memory of full age to execute a Will and was not under any restraint to the Knowledge, information or belief of this deponent and further these deponents say not. Waddell, Probate Judge Johnston County Certificate of Probate - In the Probate Court The 8th day of September 1883. In the matter of the will of Alvin Coats deceased - A paper writing purporting to be the last will and testament of Alvin Coats deceased is exhibited for Probate before me L. R. Waddell, Judge of Probate for said County by John R. Coats the Executor therein named and P. T. Massey and J. H. Parrish the subscribing witnesses thereto having been duly sworn, each deposed and said that they are each a subscribing witness to said Will, and that the said Alvin Coats subscribed the same in their presence. They further said that the said Alvin Coats at the time of subscribing the same, declared the said writing to contain his last will and Testament; and they did each thereupon at the request and in the presence of the said testator, subscribe their name as an attesting witness thereto; and further that at the time of the subscribing as aforesaid, the said Alvin Coats was of sound mind and memory, of full age to execute a will, and under no restraint to their knowledge and belief. Thereupon it is adjudged by the Court that the said paper writing and every part thereof is the last will and testament of the said Alvin Coats and the same is ordered to be recorded and filed.
