Devised September 2, 1797, No Probate Date Given [before May 28, 1798 – Date of Inventory]. State of North Carolina, Johnston County. In the name of God Amen, Second day of September Ano Domini One Thousand Seven Hundred Ninety Seven, I, Amos Johnson of the county and State aforesaid being sick of body, but of good sound and perfect memory thanks be to Almighty God and calling to mind the uncertain estate of this transitory life and that all flesh must yield to death when it doth please God to call, do make and constitute, ordain, and declare this my last will and testament in manner following, revoking and making null and void all other wills and testaments by me made, this only to be my last will and testament and none other to be of any effect, and now for selling to my temporal estate and such goods and chattels as it hath pleased God to bestow upon me, I do ordain give and dispose of the same in manner and form following, that is to say: First, I desire my body decently buried at the discretion of my executors hereafter mentioned, also I desire all my just debts to be paid. Item, I lend to my well beloved wife Mary Johnson the plantation where I now live containing Two Hundred and Thirty Six acres of land with the improvements during her life or widowhood at her death or marriage. Item, I give and bequeath unto my son James Johnson the same plantation land improvements. Item, I give and bequeath unto my well beloved daughter Mary Johnson one bed and furniture, and two cows and their increase, two new pewter dishes, three basins and six plates, one small iron pot, and one bell metal skillet, one new washing tub and pail and can, and one large glass bottle to her and her heirs forever. All the remainder of my stock, horses, cattle, hogs, and sheep, and beds and furniture, and all my household furniture that is not before mentioned and plantation tools of all sort and all the utensils belonging to said plantations I lend to my wife Mary Johnson during her life or widowhood and after her death or marriage, I order, give, and bequeath them and all the same which I lend to my wife and their increase to my son James Johnson to him and his heirs forever. Item, I give to my son Abel Johnston five shillings. Item, I give to my son Amos Johnson five shillings. Item, I give to my son Allen Johnson five shillings. Item, I give to my son Willie Johnston five shillings. Item, I give to my daughter Lucy Stevenson five shillings. Item, I give to my daughter Phebe Matthews five shillings. Also I give to my wife Mary Johnson all the ready money I am possessed with at my death to be at her disposal. I do hereby nominate, constitute, and appoint my sons Amos Johnson and Willie Johnson my whole and sole executors of this my last will and testament, In witness whereof I hath hereunto set my hand and seal the day and year first above mentioned. [No Date] Was Exhibited for probate the last Will and Testament of Amos Johnson, Sr. which was duly proven in open Court by the Oaths of Amos Johnson, Jr. and James Johnson, two of the Subscribing evidences thereunto, when Amos Johnson, Jr. and Willie Johnson the Executors therein named Came into Court and Qualified as such Agreeable to Law. Ordered that the same be Recorded, and that Letters Issue. And that [at] the same time the said Executors returned on Oath an Inventory of said Decd. Estate, which was Ordered to be Recorded. Johnston County, NC Record of Estates, Book 3, p. 220. A true and perfect inventory of all and singular the goods and chattels of Amos Johnson, Sr. decd. taken the 28th day of May AD 1798. Note: The Johnston County, NC Court Minutes between 1798 and 1801 are missing, so it is impossible to ascertain the exact probate date of this will. However, the Johnston County, NC Record of Estates contain an undated probate of the will, and indicate that the inventory of the estate of Amos Johnson was made May 28, 1798.
