Devised October 11, 1807, Probated November 23, 1807. In the Name of God Amen, I, Henry Johnson, Senr. of the County of Johnston in the State of North Carolina being in a low state of health, but in perfect and sound mind and memory, for which I am truly thankful to Almighty God, Do this Eleventh day of October, in the year of our Lord One Thousand Eight Hundred and Seven, make and ordain this my last Will and Testament, as follows (To wit): Item, I give and bequeath unto my son Drury Johnson the following negroes, to wit, Andrew, Patience, and Winny to him and his heirs forever. Item, I give and bequeath unto my Daughter Jerusha Busbee the following negroes, to wit, Skipper, Willis, and Handy to her and to her Heirs forever. Item, I give and bequeath unto my Daughter Druzilla Pate three negroes named Tempy, David, and Green to her and to her heirs forever. Item, I give and bequeath unto my beloved Wife Patsy Johnson one Tract of Land containing about Three Hundred Acres, lying on the South side of the Marsh Branch adjoining the Lands of Drury Johnson and others, one negro girl named Penny, to her and her heirs forever, And also one Bay Mare called Nanee. And it is further my [will] and desire after the payment of my Just Debts, that all my property of every kind, not before willed, be equally divided between my wife, and all my surviving children, and not to the representative or representatives of my deceased child or children. And I hereby constitute and appoint my son Drury Johnson my sold Executor of this my last Will and Testament, hereby making null and void all other or former wills or Testaments by me heretofore made, and declaring this and only this to be my last Will and Testament. In Witness whereof I the said Henry Johnson Senr. have hereunto set my hand and seal the date above written. Signed, Sealed, Published and Declared by the said Henry Johnson Testator to be his last will and Testament in the presence of [No Names Listed] Johnston County November Term, 1807. Then was the above will exhibited in open court for probate which was duly proven and ordered to be recorded. R. Sanders, C.S.C. Johnston County, NC Court Minutes, Book 7, 1805-1807, p. 225. November 23, 1807, Was exhibited for Probate by the Executor the last Will & Testament of Henry Johnson Sen. Decd. and there being no Subscribing witness thereunto, the Court proceeded to hear the testimony of Reuben Sanders who deposed to the due Execution of the Same, when Drury Johnson the Executor therein named Came into Court and Qualified agreeably to Law, It is therefore Ordered that Said Will be Recorded, & that Letters issue. And it is further Ordered that John Carrell, Sill Johnson & Philip Johnson be appointed Commissioners to divide Such part of the Residue of the Personal Estate of Said Decd. as the Executor thereof may deem expedient at this time, and that they report their proceedings thereon to the next Court to be held for this County.
