Devised July 23, 1888, Proven December 29, 1904. I Elizabeth A. Langdon of the County of Johnston and State of NC being of sound mind and memory, but considering the uncertainty of my earthly existence, do make and declare this my last Will and Testament in manner and form following, that is to say. First, That my executor (hereinafter named) shall provid[e] for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts howsoever and to whomsoever owing out of the moneys that may first come into his hands as a part or parcel of my estate. Item, I give and devise to my beloved son R. F. Langdon my clock, side board, and hive of bees and my one horse wagon. Item, I give and devise to three of my daughers, viz.: Martitia Ann Magee, Sarah Barbour, and Eleanor Coats all my beds and bed furniture together will all kitchen utencils and furniture, All my Stock that my be in my possession at my death. Item, I give and devise to my three sons, viz., Rufus Langdon, J. M. Langdon, and R. F. Langdon my blacck Smith tools and my cross cut saw and buggy and harness. In consideration of havin[g] previously given my daughter Talitha Johnson one note of hand against her husband C. F. Johnson, which was equal to and amounted to one hundred and fifty three dollars, I do hereby give and devise to her the said Talitha Johnson the Sum of fifty cents to be paid by executor out of any money that may come into his hands from my estate. And lastly I do hereby consitute and ap[p]oint my Son J. M. Langdon my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof. In witness whereof I the said Elizabeth A. Langdon do hereunto set my hand and seal this 23rd day of July A.D. 1888. Signed sealed and published and declared by the said Elizabeth A. Langdon, being duly sworn, doth say: That Elizabeth A. Langdon, late of said County, is dead, having first made and published h[er] last Will and Testament; and that J. M. Langdon is the executor named therein. Further, that the property of the said Elizabeth A. Langdon, consisting of Household & Kitchen furniture and $100.00 in money is worth about $150.00, so far as can be ascertained at the date of this application, and that R. F. Langdon, Rufus Langdon, J. M. Langdon, Martitia Ann McGee, Sarah Barbour, Ellanor Coats, and Talitha Johnson all of full age and residents of Johnston County are the parties entitled under said will to the said property. State of North Carolina Johnston County In the Superior Court A paper purporting to be the last Will and Testament of Elizabeth A. Langdon deceased, is exhibited before me the undersigned, Clerk of Superior Court for said County, by J. M. Langdon, the executor therein mentioned, and the due execution thereof by the said Elizabeth A. Langdon is proven by the oath and examination of Rufus Langdon and John Stephenson the subscribing witnesses thereto; who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper-writing now shown him, purporting to be the last Will and Testament of Elizabeth A. Langdon; that the said Elizabeth A. Langdon in the presence of this deponent, subscibed h[er] name at the end of said paper-writing, which is now shown as aforesaid, and which bears date of the 23rd day of July 1888. And the Deponent Further Saith, That the said Elizabeth A. Langdon, the testatrix aforesaid, did, at the time of subscribing her name as aforesaid, declare the said paper-writing so subscribed by her, and exhibited, to be her last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testatrix. And this deponent further saith, that at the said time when the said testatrix subscribed her name to the said last Will as aforesaid, and at the time of the deponent subscribing his name as an attesting witness thereto, as aforesaid, the said Elizabeth A. Langdon was of sound mind and memory, of full age to execute a Will, and was not under any restraint, to the knowledge, information or belief of this deponent: And further, these deponents say not. Severally sworn and subscribed, this 28th day of July 1904 & 29 Dec 1904, before me. W. S. Stevens John Stephenson Clerk Superior Court Rufus Langdon State of North Carolina Johnston County In the Superior Court It is therefore considered and adjudged by the Court that the said paper- writing and every part thereof is the last Will and Testament of Elizabeth A. Langdon, deceased, and that J. M. Langdon is a suitable person for executor. Let the said Will, together with the probate, be recorded and filed. This 29 day of Dec 1904. W. S. Stevens, Clerk Superior Court Johnston County, NC Will Book 4, 1892-1905, p. 524. State of North Carolina Johnston County In the Superior Court In the Matter of the Last Will of Elizabeth A. Langdon It appearing to the Court by the oath and examination of Rufus Langdon and John Stephenson, the subscribing witnesses thereto, that the paper-writing propounded by the executor therein named, is the last Will and Testament of Elizabeth A. Langdon and that the same was duly executed by said Elizabeth A. Langdon in the presence of said witnesses, and that at the time of t signing the same the said Elizabeth A.Langdon was of sound mind. It is thereupon adjudged that the said paper-writing be admitted to probate as the last Will and Testament of the said Elizabeth A. Langdon, and the executor therein named qualify as such. This the 29 day of Dec 1904. W. S. Stevens, Clerk Superior Court State of North Carolina Johnston County In the Superior Court I, J. M. Langdon, do swear (or affirm) that I believe this writing to be and contain the last Will and Testament of Elizabeth A. Langdon, deceased; and that I will well and truly execute the same by first paying his debts and then his legacies, as far as the said estate shall extend, or the law will charge me, and that I will well and faithfully execute the office of an executor agreeable to the trust and confidence reposed in me, and according to law: so help me God. Stevens, Clerk In Re: Estate of Elizabeth A. Langdon, Deceased A paper-writing purporting to be the last Will and Testament of Elizabeth A. Langdon deceased, is exhibited in open Court for probate by J. M. Langdon, Executor therein named, and the due execution thereof by the said Elizabeth A. Langdon, deceased, is duly proven by the oath and examination of Rufus Langdon and John Stephenson subscribing witnesses thereto; and it is further shown to the satisfaction of the court by said witnesses that the said Elizabeth A. Langdon was, at the time of making said will, of sound mind and memory, of full age to execute a will, and under no restraint, to their knowledge, information or belief. It is Thereupon Considered, Adjudged and Decreed, that said proof is sufficient and according to law, and that said paper-writing is and contains the last Will and Testament of Elizabeth A. Langdon, deceased. And on motion it is ordered that said Will be admitted to probate and recorded in the Book of Wills of Johnston County, and as such filed as provided by law in the office of the Clerk of Superior Court of said County. It is further ordered that said J. M. Langdon be allowed to qualify as Executor as provided by law, and enter upon the discharge of the duties imposed by said trust.
