Devised December 13, 1847, Probated May 22, 1848. In the Name of God Amen, I, Elijah Lassiter of the County of Johns[t]on and State of North Carolina being of sound mind and disposing memory, do by the help of God make and ordain this my last will and testament in manner and form following, hereby revokeing all other wills made by me, viz. 1st, I give my Soul to God who gave it and my body to be decently buried in a Christian like manner. As to the goods and chattels with which God has blessed me after paying all my just debts, I leave to be disposed of in the following manner, that is to say. 2nd, I give and bequeath to my daughter Lucy Johnson wife of James Johnson one dollar she having rece[ive]d her distributive share heretofore. 3rd, I give and bequeath to my son-in-law James Johnson one dollar. 4th, I give unto my son-in-law George Stephenson one hundred dollars in money my daughter Penelope his wife has heretofore received her distributive share. 5th, As for my old servant Jude, it is my will that she be permitted to live with any of my children she may choose. 6th, All the rest and residue of my property of whatever name or nature I leave to be equally divided between my several children herein after named and subject to such regulations as herein follows (viz) unto Tillitha Johnson wife of David Johnson (deceased), Sally Whittington wife of Solomon Whittington (deceased) and William Lassiter to each one distributive share, one distributive share to Jason Lassiter, one distributive share to the heirs of James Lassiter (decesd) after deducting therefrom one hundred and five dollars and seventeen cents it being the amount which I paid William Lassiter for him the said James Lassiter decd. To Shaderick Lassiter, Patsy Carrel wife of John Carrel, Elijah Lassiter, and Elisha Lassiter each one share and to Mary Woodall, wife of Gideon Woodall Senr. (deced) one share after deducting therefrom the sum of seventy six dollars and thirty two cents which I advanced to her in payment for land, as is herein directed to my several children for and in consideration of love and natural affection I give and bequeath unto them and their heirs forever. I nominate, constitute, and appoint my son William Lassiter Executor to this my last will and testament whom I request after my deceased to consult with my children or as many of them as may be convenient and proceed to make sale or divide my property as is herein directed as they may think best. In witness whereof I the said Elijah Lassiter have hereunto set my hand and affixed my seal this the thirteenth day of December one thousand Eight hundred and forty seven. May 22, 1848, A paper Writing purporting to be the last Will & Testament of Elijah Lassiter decd. is produced in open Court and Offerd for probate, When David Avera, Jr. one of the subscribing Witnesses Thereto being duly Sworn in Open Court Deposeth and Saith that he saw the said Elijah Lassiter execute and Seal the same, by making his Mark thereto, that he witnessed it at the request of the said Elisha [Elijah] Lassiter and in his presents and also did John H. Kenneday the other Subscribing Witness, and that the said Elijah Lassiter was of Sound mind and disposing Memory and in his perfect senses Capable of making a Will, therefore the Court doth pronounce and declare that the same is the Last Will and Testament of Elijah Lassiter deceased and doth order it to be recorded as his last Will and Testament, And on motion William Lassiter the Executor therein named appears in open Court and takes the Oath of Executor & is duly Qualified as Executor thereto.
