Devised December 23, 1874, Probated March 31, 1875. I, William Lassiter of the County of Johnston and State of North Carolina, being of sound mind and memory, but considering the uncertainty of my earthly existence, do make and declare this my last Will and Testament in manner and form following, that is to say: First - That my executors shall provide for my body a decent burial, suitable to the wishes of my relations and friends, and pay all the Expense together with all my just debts, howsoever and to whomsoever owing, out of the moneys that may first come into their hands as part or parcel of my estate. Item, I give and devise to my beloved wife Lucy all the tract of land whereon I now live containing about Six hundred acres, during the term of her natural life, also her life estate in my tract of land, known as my Mill Tract, containing about seventy acres; together with all my household and kitchen furniture of every description, and all my tools and farming utensils, Buggy, Cart &c. to have during her natural life, afterward to be disposed of as follows: Item, I give and bequeath to my daughter Martha wife of Samuel Jones, five hundred ($500) in lieu of land. Item, I give and bequeath to my daughter Mary wife of George Stephenson, five hundred ($500) dollars in lieu of land. Item, I give and bequeath to my daughter Sarah wife of George Keen, five hundred ($500) in lieu of land. Item, I give and devise to my grandson Joseph E. Lassiter, one hundred acres of land, to be cut off from the Western side of the tract on which I now live, including the Flowers tract, to be his at his disposal forever. Item, My will and desire is that after the death of my beloved wife, that the tract of land whereon I now live, be sold, in one or more tracts as circumstances may require, also my Mill tract containing about seventy acres, together with all the residue of my Estate, after taking out the above legacies, shall be sold and the debts owing to me collected, and the surplus over and above the payment of debts and expenses, be equally divided amongst all my heirs, viz. Alfred Lassiter one share, Shadrach B. Lassiter one share, the heirs of my son Sir William Lassiter deceased one share, Henry S. Lassiter one share, Joseph A. Lassiter one share, Calvin Lassiter one share, the heirs of my older daughter Elizabeth, deceased, who was the wife of Edmund Johnson, one share, Martha wife of Samuel Jones, one share, Mary wife of George Stephenson one share, Sarah wife of George Keen one share (making ten shares in all, in which the residue of my estate will have to be divided) in equal portion share and share alike to them to each and every of them, their executors, administrators, and assigns, absolutely forever. I hereby appoint my eldest son Alfred Lassiter and my youngest son Calvin Lassiter the lawful executors to execute this my last will and Testament. In witness whereof I have signed, sealed, and published and declared this instrument as my last Will and Testament the 23rd day of December A.D. 1874. Carrell Langdon Seth Woodall Johnston County - In the Probate Court In the matter of the Will of William Lassiter before J. H. Abell, Judge of Probate. Alfred Lassiter and Calvin Lassiter being sworn doth say: That William Lassiter, late of said County, is dead having first made and published his last Will and Testament; And that Alfred Lassiter and Calvin Lassiter are the executors named therein. Further, that the property of the said William Lassiter consisting of Real and personal estate is worth about $6000.00, so far as can be ascertained at the date of this application. And that Lucy Woodall, Esrom Johnson, Sir William Johnson (Children of Edmund Johnson), Martha Jones, Alfred Lassiter, Mary Stephenson, S. B. Lassiter, Sarah Keen, The Children of Sir William Lassiter decd., H. S. Lassiter, J. A. Lassiter, and Calvin Lassiter who are all residents of Johnston county and all of full age except the children of Sir William Lassiter, are the parties entitled under the said will to the said property. Sworn to and subscribed before me this 31st day of March, 1875. Alfred Lassiter J. H. Abell, Probate Judge Calvin Lassiter March 31, 1875, In the Matter of the Will of William Lassiter deceased. Certificate of Probate. A paper writing purporting to be the last Will and Testament of William Lassiter deceased is exhibited for Probate, before me J. H. Abell, Judge of Probate of said County, by Alfred Lassiter and Calvin Lassiter the Executors, therein named; And thereupon Carrell Langdon and Seth Woodall, the subscribing witnesses thereto, being duly sworn, each deposed and said: That they are each a subscribing witness to said will, and the said William Lassiter subscribed the same in each of their presence. They further said that the said William Lassiter at the time of subscribing declared the said writing to contain his last Will and Testament and they did each thereupon, at the request and in the presence of the said testator, subscribe their name as an attesting witness thereto, and further, that at the time of the subscribing aforesaid the said William Lassiter was of sound mind and memory, of full age to execute a will, was under no restraint to their knowledge or belief. Thereupon, it is adjudged by the court, that the said paper writing and every part thereof, is the last Will and Testament of the said William Lassiter and the same is ordered to be recorded and filed.
