Johnston County, NC - WILL of Phebe Mclam - 1857 File contributed for use in USGenWeb Archives by "Lesley Looper" I Phebe Mclam of the cunty of Johnson and the state of North carolina Being of sound mind and memory But considering the uncertainty of my Earthly Existance do make and Declare this my last Will and testament in manner and form following that is to say First that my executor hearinafter Named sall provide for my Body a Decent Burial suitable to the wishes of my Relation and friends and pay all funeral Expences together with my just debts howsoever and to Whomsoever owing out of the moneys that may first come into his hands as a part or parcel of my estate Item I give and Bequeath to my Daughter Spicy Mclam the sum of three hundred Dollars to Be paid By my Executor within two years from the time of my death out of my moneys Belonging to my estate not otherwise disposed of. Item I give and Bequeath to my youngest Daughter Phebe Mclam the sum of three hundred dollars to Be paid by my executor herein after named as the above bequeaths I give and Bequeath to my Spicy McLamb and Phebe Mclam two choice Beds and all my clothing and all the Bed clothing that I shall leave on hand at my Death and all the spun coton included and cloth to the same to have and to hold to them and to there heirs in fee simple forever. Item my Will and Desire is that all the Residue of my Estate if any after taking out the devised and legacies above mentioned shall Be sold and the debts owing to me collected; and if there should Be any surplus over and above the payments of debts, Expenses and legacies that such surplus shall Be equally divided and paid over to all my children in equal proportion shear and shear alike to them and each and every of them their Executors administrators and assigns absolutely forever. and latly I do hereby constitute and apoint my trusty friend Nathan Tart Junr my lawful executor to all intent and purposes to execute this my last Will and testament according to the true intent and meaning of the same and Every part and clause thereof hereby Revoking and declaring utterly void all other Wills and Testaments by me heretofore made In witness whereof I the said Phebe Mclam do hereunto set my hand and seal this 28 of February A D 1856 Signed sealed published and declared by the said Phebe Mclam to Be her last will and testament in the presance of us who at her Request and in her presence do subscribe our names as Witnesses thereto. her Phebe x Mcam (seal) mark Furney Tart Isaac L Moore Johnston County Court February Term 1857 Then was this paper writing duly proven in open court by the oath of Furney Tart and Isaac L.
