Devised June 20, 1779, Probated November 26, 1782. In the Name of God Amen, the Twentieth Day of June, 1779, I, Edward Penny of the County of Johnston in North Carolina, planter, being sick and very weak in body but of perfect mind and memory, Thanks be given unto God, therefore calling unto mind the mortality of my Body and knowing that it is appointed for all men once to Die, Do make and ordain this my Last will and Testament that is to say, first of all, I give and recommend my soul into the hands of Almighty God that gave it and my Body I Recommend to the Earth to be Buried in Decent Christian Burial at the Discretion of my Executors, nothing doubting but at the general Resurrection I shall Receive the same again by the mighty power of god, and as Touching such worldly Estate wherewith it has pleased God to Bless me in this Life, I give and Dismiss and Dispose of the same in the following manner and form. First, I give and bequeath to my well Beloved son James Penny one feather bed and furniture, two cows and calves, and one mare, and one ewe and lamb. Item, I give and bequeath unto my son Jesse Penny one feather bed and furniture, one cow and calf, and one ewe and lamb. Item, I give and bequeath to my Daughter Elizabeth Penny one feather bed and furniture, and two Cows and Calves, and one ewe and lamb. Item, I give and bequeath to my beloved son Edward Penny all the Land and Plantation whereon I now Dwell agreeable to a Deed that I obtained of William Wood, Sr., and the brandy still and four hundred acres of new entered land, Being in two Grants lying near my plantation, to take possession immediately after my wife Elizabeth Penny's Decease and not before and if my son Edward Penny dies without heirs, then to go to my son James Penny, and if in case that Edward and James Penny should both die without lawful heirs, then the same lands and still to go to Jesse Penny. I also give to my son Edward Penny one feather bed and furniture, two cows and calves, one ewe and lamb, one small gun, one young horse. Item, I lend to my Beloved wife Elizabeth Penny all and singular the Lands and plantation whereon I now live together with all my stock of all kinds, together with all my household furniture during her widowhood or life (the Legacies above mentioned excepted only), But if she marries, then for the above mentioned goods to be equally divided, allowing my wife a child's part and the use of the plantation her lifetime without any interruption. Item, I also give and bequeath the remaining part of my Estate after my wife's marriage or decease which is not already legacied out to be all equally divided between my Children, Viz. Caleb Penny, Charles Penny, Penuel Penny, James Penny, Martha Jones, Jesse Penny, Mary Utley, Elizabeth Penny, Edward Penny. Also, I likewise Constitute, make, and ordain Caleb Penny and James Penny my Executors to this my Last will and testament and I do hereby utterly disallow, revoke, and disanull every other former will by me made and Do confirm and declare this and no other to be my Last will and testament. In witness whereof I have hereunto set my hand and seal the Day and year above written.
