Johnston County, NC - Will of Thomas Pool, 1856 ~~~~~~~~~~~~~~~~~~ Will of Thomas Pool Johnston County 1856 I Thomas J Pool of the County of Johnston and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say, First, That my Executor (hereinafter named) shall provide for my body a decent burial suitable to the wishes of my relatives and friends, and pay all funeral expenses together with my just debts with all of the moneys that may first come into his hands as a part or parcel of my estate, Item, I give and devise to my brothers John W Pool all my interest in all of my property except my land and Negroes and what money may be due my estate after paying my just debts and that said John hold all and every part of my estate two years before any division for the purpose of making money to pay all debts and expenses against my estate and after that period of time I give to him and his heirs one third of my estate that is my land and negroes Item I give and devise to my sister Mary Pool one third of my estate in land and negroes and money that may be due my estate after defraying all expenses. I also give to my brother John W Pool one third of all money that may belong to my estate after defraying of my estate Item I give and devise to the children of my brother James Pool that are now born or may hereafter be one third of my land & negroes and money that may belong to my estate after defraying all expenses and that said property be held in trust by my brother John W Pool or some other suitable person for their sole use and benefit or maybe deemed best for their interest and if any of said children should die before coming of age the surviving ones to inherit there part. I further wish and devise that the trustee who may hold in trust the property belonging to the heirs of my brother James let him the said James have the same use for their benefit in raising and educating said children but not to use or make way with any part of the principle, but as they become of age each one to have his or her equal share of said intake In witness whereof I the said Thomas J Pool do hereby set my hand deal this the 16th day of June 1836, signed sealed published and declared by the said Thomas J Pool to be his last will and testament in the presence of us who at his bequest and in his presence do subscribe our names as witnesses thereof.
