S. Jones and John Eason Greeting Whereas Thomas R. Rose and others by their attorney Loverd Eldridge Esq hath heretofore exhibited their petition which is in the following words, to wit: The petition of Thomas R. Rose, Benjamin B. Rose, William N. Rose, George P. Rose, Joseph G. Rose, Avera H. Rose, Lucy E. Lee wife of Ransom Lee, Ira W. Rose an infant under twenty one years of age by his guardian John H. Kenaday respectfully sheweth unto your worships that they are tenants in common of the following slaves to wit: James, Hannah, Squire, Isaac, Joanah, Patsy, Rachael, Betsy, Martin, Vine, Esther, Wily and Juliann; your petitioners further show that they desire to hold their shares of said slaves in severalty and to that end they pray your worships to appoint three free holders unconnected with them by consanguinity or affinity to divide the said slaves into shares and to allot and set apart to each of your petitioners one of said slaves in severalty and to report their proceedings in due form of law to the next term of this court and your petitioners as in duty bound will ever pray. Loverd Eldridge Atty This cause coming on to be heard upon the petition on motion Nathan Williams, E. S. Jones and John Eason are appointed commissioners to divide the slaves mentioned in the petition as prayed for and to report to the next term of this court. You the aforesaid Nathan Williams, E. S. Jones and John Eason are therefore commanded to divide the slaves mentioned in this petition and allot to each of the petitioners their share in severalty and make report of your proceedings in due form of law to the next term of this court to be held for the County of Johnston at the court house in Smithfield on the 4th Monday in February next and have you then and there this writ. Recorded page 92 State of North Carolina Johnston County To the worshipful the Justices of the Court of Pleas and Quarter Sessions February Term 1855 In obedience to an order from your worships from November Term last of this court, to the undersigned commissioners appointed to divide the following slaves (formerly property of Nicholas Rose dec’d) James, Hannah, Squire, Isaac, Joanah, Patsy, Rachael, Betsy, Martin, Vine, Esther, Wily and Juliann, among the heirs of said dec’d in severalty, beg leave to report that they have performed the duty assigned them, except as to James, who your commissioners believe to be super annuated and being unwilling to tax one of the heirs with him, have left him in common stock, or in the hands of the executor, to be disposed as they may deem best, their will also an increase of two children since the petition was filed, Betsey and Emeline, which were also divided, the value of them divided was estimated at ($7525) seven thousand, five hundred and twenty five dollars making each share ($940.62 1/2) nine hundred and forty 62 1/2 dollars which was numbered and drawn as follows. Lot No. 1 Drawn by William N. Rose, Negro boy Squire valued at ($1150) eleven hundred and fifty dollars and pays ($209.37 1/2) two hundred and Nine 37 1/2 dollars as follows, to lot No. 4 ($140.62 1/2) one hundred and forty 62 1/2 dollars and to lot No. 5 ($68.75) sixty eight 75/100 dollars. Lot No. 2 Drawn by George P. Rose, Negro woman Patsey and child Emeline, valued at ($900) nine hundred dollars, and receives ($40.62 1/2) forty 62 1/2 dollars from lot No. 7, ($6.25) six 25/100 dollars, and from lot No. 6 ($34.37 1/2) thirty four 37 1/2/100 dollars. Lot No. 3 Drawn by Ransom Lee in right of his wife formerly Lucy Rose, Negro woman Rachael and child Betsey valued at ($900) nine hundred dollars and receives ($40.62 1/2) forty 62 1/2/100 dollars from lot No. 7. Lot No. 4 Drawn by Ira W. Rose, Negro girl Hannah valued at ($800) eight hundred dollars and receives ($140.62 1/2) one hundred and forty 62 1/2/100 dollars from lot No. 7. Lot No. 5 Alloted to Benjamin B. Rose by consent of the heirs, Negro girl Joannah valued at ($850) eight hundred dollars and receives ($90.62 1/2) from lot No. 1, ($68.75) sixty eight 75/100 dollars, and from lot No. 7 ($21.87 1/2) twenty one 87 1/2/100 dollars. Lot No. 6 Drawn by Avera Rose, Negro girl Betsey and Juliann valued at ($975) nine hundred and seventy five dollars and pays ($34.37 1/2) thirty four 37 1/2/100 to lot No 2.
