Devised November 23, 1848, Proven May Term, 1850. In the name of God Amen. I Jacob Woodall Sen. Of the County of Johnston and State of North Carolina being of sound disposing mind and memory do the 23rd day of November A.D. 1848 make publish and declare my last will and testament in form and manner following, to wit. Item 1st I give to my son William one Negro man by the name of Sam and Negro Girl by the name of Spicy, to him and his heirs forever. Item 2nd I give to my daughter Sinderella one Negro man by the name of Joe and one Negro Girl by the name of Nervy to her and her heirs forever. Item 3rd I give to my son James G. one Negro boy by the name of Arter and one Negro woman by the name of Silvy together with her increase to him and his heirs forever. Item 4th I lend to my daughter Charity during her natural life one Negro Girl by the name of Rachel and after her death it is my will that the said Rachel be given to her lawful Children to them and their heirs forever. Item 5th I lend to my beloved wife Lucy one Negro man by the name of Silas and one Negro woman by the name of Sook for and during the term of her natural life and after her death it is my will that the aforesaid Negroes be sold and the monies arising from such sale be equally divided in the following manner, to wit: to my son William one fourth part, to my daughter Sinderella one fourth part, to my son James G. one fourth part, and to the lawful Children of my daughter Charity one fourth part to them and their heirs forever. Item 6th I lend to my beloved wife Lucy during her natural life two feather beds together with all their necessary furniture, one Chest, one Table, Beaufat, one set of Cups and saucers, two Earthen dishes and one Pewter dish, six Pewter plates, one Jug, two glass bottles, one case of knives and fork, six earthen plates, six spoons, one Coffee Pot, one sugar dish, one earthen pitcher, six earthen bowls, two pewter basins, two mugs, two pots, two pair of pot hooks, one spider, one skillet, one loom and gear, one flax wheel, one woollen wheel, one pair of Cotten Cards, one pair of woollen Cards, one set of water vesels, six setting Chairs, one bible, testament, and hymn book, eight cider Barrels, one Cider hogshead, one open head hogshead, one bread tray & meal sifter, one wooden bowl, one meal barrel, one Jar, one spice mortar, one pepper box, one horse and horse bell, two Cows and Calves, and one Cow bell, five head of sheep and one sheep bell, eight dry hogs, two sows and pigs, two Cutter plows, one dager plow, one set of plow gear, one plow stack, two Club axes, two grubbing hoes, two weeding hoes, one iron wedge, one drawing knife, one hand saw, two augers, two Chisels, one gimlet, one Claw hammer, one horse cart, one bridle and saddle, one pair of and irons tongs and shovel, one milk house and one churn in all the articles enumerated in the above. Item 7th it is my will that my wife shall have her choice and after her death it is my will that all the articles above lent that remain free from wear or waste be sold by my Exr. Hereinafter named at public sale and the monies arising from such sale to be equally divided between my four Children, to wit. William, Sinderella, James G., and Charity to them and their heirs forever. Item 8th I give to my b[e]loved wife Lucy out of the stock, crops, and provisions on hand a plentiful support for herself and her family for one year and if there be an insufficiency an equivalent in money as shall make a plentiful support for herself and family for the term of one year. Item 9th I lend to my wife Lucy during her natural life the plantation whereon I now live together with all my lands and plantations not above disposed of and after death it is my will that the tract of land whereon I now live containing about three hundred and twelve Acres be equally divided between the lawful Children of my daughter Charity the survivor or survivors of them to them and their heirs forever. The residue of my lands loaned in the above Item being about two hundred and thirty two Acres which includes my upper plantation I dispose of it as follows, to wit after the death of my wife I give the said two hundred and thirty two Acres to my daughter Sinderella to her and her heirs forever. Item 10th It is my will that the residue of my property not disposed of or enumerated in the above items be sold after my death at publick sale by my Exr. Herein after to be appointed and all the debts due me to be collected and out of such sales and collections my Just debts to be paid and the balance to be equally divided between my four Children namely William, Sinderella, James G., and Charity to them and their heirs forever. And I do her[e]by constitute and appoint Seth Woodall Executor to this my last will and testament signed sealed published and declared by the testator as his last will and testament the day and year first above written. Matthew Giles John Woodall Jacob Woodall (Seal) Whereas, I, Jacob Woodall sen. have made my last will and testament in writing, bearing date the 23rd day of November A.D. 1848, as circumstances now require I do this my writing, which I hereby declare to be a Codicil to my said will, to be taken and construed as a part thereof, lend to my beloved wife Lucy, for and during the term of her natural life one Negro girl by the name of Leuzilla and after the death of my wife it is my will that the said Negro be sold by my Executor and the monies arising from such sale be divided in the following manner, to wit., to my son William one fourth part, to my daughter Sinderella one fourth part, to my son James G. one fourth part, and to the lawful Children of my daughter Charity one fourth part. In testimony whereof I hereunto set my hand and seal this the 26th day of May A.D. 1849. Signed, sealed, published, and declared by the said Jacob Woodall Sen. to be a codicil or part of his last Will and Testament, in presence of us, who at his request and in his presence do subscribe our names as witnesses.
