Marble http://www.genrecords.net/emailregistry/vols/00022.html#0005285 April 25, 2011, 8:16 pm Source: Elizabeth Moore Collection Written: 1832 INDENTURE - DILLAHUNTY TO WIGGINS Found in the Elizabeth Moore Collection, NC Archives This Indenture made this Sixth day of October In the year of Our Lord One thousand and Eight Hundred and thirty two Between Samuel Dillahunty of the State of North Carolina and Jones County of the One part and Caleb Wiggins Citizen of Lenoir County and State aforesaid of the Other part – Witnesseth that I the aforesaid Samuel Dillahunty being appointed the Lawful and true Agent of John S. Lavender and his Wife Elizabeth Lavender Citizens of the State of Georgia by a good and Lawful power of Attorney which beares date the fifth day of march Eighteen Hundred and Twenty nine and Witnessed by Scarborn Delk and Annon Tice and Sent me the Said Samuel and now I the Said Samuel for & in Consideration of the Sum of four Hundred Dollars to me in hand paid before the Sealing and delivering of these present now bargained and Sold unto the Said Caleb Wiggins a certain Tract of Land lying and being in the County of Lenoir Lying on the North Side of Nuce River and between Nuce and Contenteny Creek and Boundered as follows Beginning at a Small pine Thomas Phillips corner and the Given line of Lamberts patent and Turning then with Lamberts give line South Eleven degrees East two Hundred and forty two poles to a forked gum near Brantons Corner then North thirty degrees East five poles to a larger Red Oak in Brantons line then with Brantons line north Eighteen Degrees East two hundred and forty two poles to a Large Red oak Said to be Brantons Corner then North Twenty degrees west fifty two poles with Brantons other Line to his corner a Read Oak and Phillipses Old Corner tree then with Thomas Phillips line to the Beginning by patent Baring Date the 27th day of October 1784 and in the year of the Independence and patented by John Phillips Containing One hundred and ten acres be the Same more or less which Land I the said Samuel have Sold and firmly by these presents doth Bargain Sell alien and confirm that the aforesaid Caleb Wiggins which Lands was purchased by Furnifold George and by his Death fell to the Said John S. Lavender and his Wife Elizabeth, freely and fully from me my heirs and assigns for ever or the Lawful Claim or Claims of the said John S. Lavender or his wife Elizabeth or their heirs Executors administrators or assigns for ever, with all the profits whatsoever, mines minerals, herideterments, and advantages, assertaining or in any wise there unto belonging to him the said Caleb Wiggins his heirs Executors administrators or assigns for Ever, Clearly and fully by these present to have and to hold and the Same peaceably to Enjoy to him or their only use forever in Witness Whereof I have hereunto Set my Hand and affixed my Seal this day and date first above written, Signed Sealed and delivered in the presents.
