Jones County, NC - Will of Simon Foscue, 1814 ~~~~~~~~~~~~~~~~~~~~ WILL OF SIMON FOSCUE Copy of Will found at the NC Archives, NC Supreme Court Case #1343. In the name of God Amen I Simon Foscue of the County of Jones and State of North Carolina, being sick of Body, but in perfect mind & memory, do make & ordain this my last Will & Testament in manner & form following – Imprimes I lend to my beloved wife Ann Foscue during her natural life time Fifty acres of land at my plantation on the river Including the one half of the dwelling House the last part & one Kitchen, and the privilege of pasturage on said plantation for her stock, also I lend my wife the whole of my Batcheler Creek plantation during her natural life time, also I give to my beloved wife Ann Foscue the following property to her & her heirs forever, Five cows and Calvin, my riding mare saddle & bridle, one place & gears, one Bed & furniture at Batcheler Creek, one wooling wheel & a lenin wheel, one loom & all that – instrument torn and not readable for several words – large chest at Batchelers Creek one pine Table all the kitchen furniture at Batchelers creek all the chairs & crockeryware at Batchelers creek also I lend my wife during her natural life time all the stock of cattle & Hogs which I hereafter give to my son Amos Foscue & he making good the number but also I loan my wife during her natural life time or widowhood two negroe boys Joe & Gilbert which negroes I hereafter give to my son Amos, also I give my wife my riding chair & harness to her & her heirs forever Item. I give to my son Frederick Foscue & my daughter Rachel each one shilling Sterling to them & their heirs for ever - - Item. I give to my son Simon Foscue the following negroes viz. Jerry, Dick & Frank that is now in his possession and Nanie, Levin & Mary that is now in my possession to him his heirs & assigns for ever Item. I give & bequeath to my daughter Dorcas Foscue the following negroes viz. Patience, Qubel ??? and Marrian???, one Bed, bedstead and furniture six silver teaspoons in the possession of Simon Foscue to her & her heirs forever Item. I give to my daughter Sally Foscue the following negroes Charles, Peter & Lucy & one bed & furniture to her heirs & assigns for ever Item: I give to my son Lewis one hundred acres of land of my plantation on Trent adjoining the Lands of Mr. Edward Mumford beginning at a cornerstone & running to a cornerstone the dividing line between him & my son Stephen also a negro boy Moses to him his heirs & assigns forever Item. I give to my son Stephen Foscue all my Lands on Trent excepting one hundred acres given to Lewis also the land I bought of Robert Kornegay adjoining Hatches quarters?? Also the following Negroes Tom, - instrument torn -, a girl Jermy also one young mare called Jenny & her colt, three cows & calves, two sows & pigs ten head of sheep one yoke of oxen, two plows & gears one cart & wheels, one maple & one mahogany table, one dirth ??, all the chairs belonging to the house on the river plantation, one bed bedstead & furniture, one cupboard, one pare andirons, one pare wedges two anes ??, three hoes, one chest, one dish half dozen plates knives & forks, one looking glass, two pots, hooks & tramels and all my Blacksmiths tools, and one hand mill all of the above to my son Stephen his heirs and assignes for ever Item. I give to my daughter Betsey the following Negroes, Lettue, Dick & Norris, also one bed bedstead and furniture, and one large chest & all that – next few words torn – that was her mothers, one bason and one wooling wheel to her her heirs and assigns for ever Item. I give & bequeath to my daughter Susannah Foscue the following negroes, Wile, Jim, Gude, also one bed and furniture one set silver teaspoons, one black chest that was her mothers one young mare a sorrel to her her heirs & assignes for ever Item. I give & bequeath to my son Amos the following property, viz. All my lands on Batchelers Creek and twenty five acres on the Beaverdam, three Negro boys Joi, Gotboat & Jack & a small bay called George three cows & calves, all the stock of hogs belonging to the Batchelers creek two beds & furniture at Batchelers creek, one mahogany Table one cupboard one bay mare, to him his heirs & assigns for ever I lend my beloved wife Ann Foscue all the personal property given to my Son Amos until he becomes of age, the making good the quanity – the next two lines torn – to my wife until Amos becomes of age. It is my will & desire that my executors hereinafter mentioned should dispose of all the remainder of my property which together with what money I have due me shall be assigned after paying all my just debts to the education of my children and should there be any remaining I wish it divided equally between my four youngest children. My further will & desire is that Stephen shall have immediate possession of his property and to manage for himself under the directions of my son Simon. Item. I give to my wife’s son John Stephenson one gray mare called Hawk, a saddle & bridle to him his heirs & assigns forever. Lastly I nominate and appoint my sons Simon and Stephen as executors & my wife Ann executrix to this my last Will & Testament revoking and disavowing all others heretofore by me made.
