All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jo Huettl johit@suddenlink.net November 3, 2009, 6:15 pm Source: Nc Archives & History Written: 1834 Copy obtained from State Achieves in Raleigh, NC (Front Sleeve - Tobias Koonce Will, 1833 Recorded Book B, Page 121 A) Tobias Koonce In the name of God Amen I Tobias Koonce of the county of Jones and State of North Carolina (Planter) being weak in body but of perfect sound mind & memory do make and ordain this to be my last will and testament in manner and form following I recommend my soul to God that gave it me, and my body to the Earth from whence it was taken, to be buried in a decent Christian manner at the discretion of my Executor herein named and as for such worldly goods as it hath pleased God to blefs me with, I give and bequeath in manner and form following (viz) Imprimos - I give and bequeath unto my beloved wife Bonitos Koonce, (smudged jh) Negroes, rs, Sukey & Sarah which I got by her and Sarah two children Red & Mariah with all their futer increase, one sorrie horse called Paddy, two feather beds & furniture, one large chest of bed clothing wood tables which she bought here, all the crockery and furniture belonging to the prep *or carat) except the silver spoons - half dozen chairs all the dary waren and half the kitchen furniture, one horse cart & gure one clock two cows and calves or yearlings her Chaise and two heifers - onehalf of all my stock of hogs - five ewes - all the pottery of every kind, one plow and a qur - one grubbing hoe two weading hoes, all the flour that is on hand one tub with honey - all the small trunks and boxes she had before marrage two stacks of bees her chaise - one third part of all my crap of corn fodder, peas, potatoes, and two thirds of pork now killed & put up with all the lard and if the same should not be sufficient for the years support for my soier wife & family with the stock, then such deficiency to be made good to her out of the remainding part of my cropt, stock, provisions to be allotted her by my executors to her her heirs and apignes forever. Item - I lind unto my said wife Beniter Koonce for and during her natural life that part of my lands and plantation, including the house I now live in with all out houses attached thereto, lying on the lawn side of Joshuays Resolution. Beginning at a lightwood stump called Williamsons second corner, afoset the Orchid near the path cropping to the Huggins fields, and runs down into branch and the resolution to the river, then down the river to a larger pine on the river bank some ten or fifteen yards below the corner of the fence and between the fence and what is called the mouth of the roundabout then a direct line through the plantation to the beginning. Item - I give and bequeath unto my daughters Mary Pollack that part of my land and plantation lying below that loned to my wife. Beginning at a large pine standing on the River bank between this mouth of the roundabout and the corner of the fence say ten or fifteen yards below the fence and above the roundabout and runs a direct line through the plantation/leaving the dwelling house - on the upper side to a lightwood stump called Williamson corner (as described in the lone made to my wife Benita) and thence to continue in a straight line to William Huggins line then with Huggins line to NB Burkes (now Peter Andrews line) then with said Burkes or Andrews line to the River, then up the River to the beginning indeeding all the land own or hold below the aforementioned direct line - to her heirs and apignes forever. Item. I give and bequeath unto my said daughter Mary Pollack one Negro by John to her her heirs and apignes forever Item. I give and bequeath unto my daughter Mitilda Huggins, all my lands on the upper side of the division line between my wife Benitor and my daughter Mary Pollack it being attempts lands I own above a direct line running from a large pine on the river ten or fifteen yards below the corner of my fence and between said fences and the Roundabout a direct line to a lightwood stump on the Island branch called Williamson Second Corner and then at strength on to William Huggins line thence with his line up to Benjamin Huggins line then with said Benjamin Huggins line to the River, thence down the River to the Beginning (resign only the life estate in that part of said corner to my wife Beniteo) to have and to hold unto her my said daughter Mitilda Huggins her heirs and apignes forever. Item. I give and bequeath unto my daughter Matilda Huggins two Negroes Jerry and Maria with all futer increase to her & her heirs and apignes forever. Also I give unto my said daughter Matilda my silver spoons to her her heirs forever. My will & desire is that after all my just debt & funeral expenses are paid the residue of my property not given away by this my will to be equally dived between my two daughters Mary & Mitilda to them their heirs and apignes forever. Lastly I do nominate and appoint my son in law Benjamin Huggins whole sole executor of this my last will & testament, herby revoking & disallowing all former wills by me made ratifying and confirming this to be my only and last will. In testimony whereof I hereunto set my hand seal this 25 day of December in the year of our Lord one thousand eight hundred and thirty three.
