The Last Will and Testament of Arthur Lipsey
Jones County, North Carolina
Dated 19 August 1794
Proved February Term 1795

The original is in the North Carolina State Archives at Raleigh.
Note the variations found between the original will and the court's
recorded copy.



In the Name of God, Amen.
I Arthur Lipsey of the County of Jones & State of North Carolina Being sick
in Body but of Perfect mind & memory Thanks be to God, & Calling to mind
the Mortallity of my Body & Knowing it is appointed for all men once to die
Do make & ordain this my last will & Testament in Manner & form following
that is to say Principally & first of all I give & Bequeath my soul into
the Hands of Almighty God that gave it me & my Body to be Burried after a
Decent Christian manner nothing doubting but I shall Receive the same again
thro' the Mighty Power of God & as Touching Such worldly Goods as it hath
pleased God to Bless me with I give & Bequeath the Same in manner & form
following --
Imprims	I Lend unto my Beloved wife Bathsheba1 Lipsey all my Estate real &
personal during her natural life
Item.	I give & Bequeath unto my son Rasco Lipsey my plantation & all my
lands that I may die possessed of, after his mother's death, to him his
Heirs & Assigns for ever -- Provided he may live to come to Lawful age. but
if not Then in that case I give & Bequeath the same Lands & plantation unto
my son Marmaduke Lipsey, after his said mothers Decease, to him & his Heirs
& assigns for ever -- I also Give unto my son Rasco, one Gun & one Feather
Bed, Bedstead, & furniture to him his Heirs & assigns for ever -- I Give
unto my sons, Rickitson, Arthur, Leml & Marmaduke, one Feather Bed &
Furniture, to Each of them one, & to Each of their Heirs & assigns for Ever.
I Give & Bequeath unto my Two Daughters Bathsheba2 & Huldah3 unto Each of
them a feather Bed, Bedstead & Furniture -- also one Cow & yearling apiece
to Each of Them  Also one Chest apiece to them & their Heirs for Ever -- I
Give & Bequeath unto my son Marmaduke one Gun to him & his Heirs for Ever --
My will & desire is, that the Negro Fellow Jem after My Wife's decease
Shall be sold & the money Equally Divided among my Surviving Children --
My will & desire further is that all my Estate not Already disposed of be
divided after my wifes Decease Equally among my Surviving Children (the
realities4 Themselves, & nothing to be sold at Vendue) by two or more
neighbouring Freeholders, Which they may choose & Every Child have its
proportional part for Ever --
And Lastly I make & ordain constitute & appoint My wife Bathsheba5 Lipsey &
my son Rickitson Lipsey Execrs to this my Last will & Testament, Revoking &
Disannulling all former wills by me made & ratifying & Confirming this my
only Last will & Testament --
In Witness Whereof I hereunto set my hand & affix my seal this 19th day of
August 1794

Jones County Court February Term 1795
Then was the aforegoing Annexed last Will & Testament of Arthur Lipsey decd
duly proved in open Court by the oath of John Hyson one of the Subscribing
Witnesses & ordered to be recorded.  At the same time Ricketson Lipsey one
of the Executors named in the Will Qualified as such agreeable to Law.
Ordered that Letters Testamentary Issue accordingly --
