I Wright Stanly of the County of Jones, and State of North Carolina, being of sound mind and memory but in feeble health and Knowing the uncertainty of life do this 7th day of July AD 1856 make publish and declare this my last will & testament in manner and form following (viz) Item first I give and bequeath unto my son Frederick Stanly the land known as my old plantation adjoining the land of Richard Greene & Benjamin F Stanly also, the following slaves, Mary & Lewis to him his heirs, and assigns forever Item second, I give and bequeath unto my son Wm F. Stanly my land known as the Turner place which I purchased of my brother Benj. F. Stanly, also Slaves Gatlin Mose, & Stephen to him his heirs, and assigns for ever Item third I loan to my daughter Sarah P. Stanly the following Slaves (viz) Mary Jane & Rewben during her Natural life and at her death, to her children if she should leave any child or children her surviving and in case of her death leaving no child or children, it is my will and desire that the said slaves loaned to her be Equally divided between all my other children Item fourth, I give and bequeath unto my daughter Nancy W. Stanly the following slaves (viz) Leah Jeni Simon, Mariah & Amos to her her heirs and assigns for ever. Item fifth. It is my will and desire that my perishable property, also my land on the South Side of little Chenquepin Creek adjoining the lands of W A Cox & Daniel Green & also one hundred acres of land [end page 1] adjoining the lands of Benj F Stanly, also my slaves William, Lewny & Ann be sold by my Executors, hereafter appointed (viz) the perishable property and Slaves on a credit of six months and the land, on a credit of twelve months, and the proceeds of said sale after paying my just debts & funeral Expenses, be Equally divided between all my children. Lastly I do hereby nominate Constitute and appoint my brother Benj. F Stanly and my son John B Stanly Executors to this my last will and testament declaring this and this only to be and Contain my last will Signed sealed published & } declared by the testator } WRight Stanly {Seal} in presence of us who at } his request & in presence of each} other subscribed our names as such} Rich W King Jesse L Barwick [end page 2] [Codicil] Whereas I Wright Stanly, have made my last will and testament in writting, bearing date the Seventh day of July, A.D.1856 and have thereby made Sundry devises and bequests, according to the then existing circumstances of my estate and in which I have directed three negroes by name Bill, Luna, and Ann to be sold, I do by this my writing, which I hereby declare to be a codicil to my said will, to be taken and con strued as a part thereof, will and direct, that the funds arising from the sale of the above named negroes shall be divided as follows, that is to say, _ To my son Frederic the sum of Two hundred and fifty dollars, to my daughter Sarah P. the sum of Two hundred and fif- ty dollars, and to my son William Franklin the sum of Three hundred dollars, and to my daughter Nancy W, the sum of Three hundred dollars, to have and to hold to them, their heirs and assign, absolutely and in fee simple forever. and I further will and direct that the surplus if any of the amount of the sale of the above named negroes, shall return into and make a part of the Surplus of my es- tate, to be disposed of by my my executor as directed in my said will and testament, of which this codicil is hereby Declared to be a part. October Term 1856 A paper writing purporting to be the last will and testament of Wright Stanly, deceased, is exhibited for probate in open court by John B Stanly one of the executors therein named (the other executor B F Stanly declining in open court to qualify as executor thereto) and there upon the due execution thereof by the said Wright Stanly is proved by the oaths of and examination of R W King, Jesse L. Barwick, and Calvin Koonce three of the subscribing witnesses thereto It is therefore considered by the court, that the said paper writing, and every part thereof, is the last will and testament of the said Wright Stanly, and the same is ordered to be recorded and filed, and thereupon the said John B Stanly one of the executors as aforesaid duly qualified as such & taking the oaths required by law the other executor B F Stanly declining as aforesaid.
