Recorded page 198 In the Name of God, Amen, I Harman WESTBROOK of the county of Jones and State of North Carolina being weak in body, but of sound and perfect mind and memory blessed be Almighty God for the same, do make and publish this my last Will and Testament in manner and form following (that is to say) First: I do lend unto my beloved wife Hannah WESTBROOK a certain piece or parcel of Land during her lifetime or Widowhood bounded as follows, viz: Beginning at a dead red oak the beginning corner of a piece of Land that I bought of Nathan & Benjamin & Benjamin STANLY and runs S 20 W 34 poles to the lower land of a ditch thence with the corner of said ditch through the field nearly S 5 W To the division fence between myself and my brother John WESTBROOK then with that fence N 88 1/2 W to a stake at the woods barn then N 8 1/2? E 68 poles to a water oak then W 67 poles to a red oak then N 27 W 18 poles to a stake in John WESTBROOK'S line then N 82 E 141 poles to the beginning supposed to be about 50 acres of land. To have and to hold the above mentioned land to her and to her use during her life time or widowhood after that to return to my beloved son Hennery WESTBROOK also I give and bequeath unto my beloved wife her choise one of my horses also I give her one cow and calf her choise one sow and pigs her choise also two yews sheep her choise also do give unto my beloved wife Three Beds and two bed stids and furniture for the same and half dozen of siting chares and all of my crackery ware & one set of knives and forks half dozen spoons and all of my pot ware and one plow and geare? & one grubbing hoe & weading hoe also poork? And corne enough to serve her and the children that are now presant with up one year also one loom and gear for the same & one wollen wheale and our pane/pair? Of cards? & one chest and table. I do now give and bequeath unto my four daughters Serenah WESTBROOK & Samantha WESTBROOK & Elzary WESTBROOK & Lucy Dorcas WESTBROOK a certain piece or parcel of land to be equally divided amongsth them when the youngest one comes of age or gets married and also - I give unto my four daughters above mentioned all of the money that my stock and --- other articles? Not mentioned in my will above brings at my vandiew? The land that I give to my daughters is bounded as follows (viz) beginning at a pine called the IPOCK Corner and runs S 82 W to a fence and ditch and with the same to a small white oak at the creek of the ditch then with the ditch up to a ash on the ditch banck by my new ground fence then a direct line from the ash to the upper and of a crop fence that Needham SMALL tended to then with that fence nearly East to my back line in the harrican poccosten then to the beginning supposed to be seventy five acres to them and their use and their heirs for ever. I now do give and bequeath unto my son Benjamin WESTBROOK 50 cents. I do also give and bequeath unto my younger son William Hennery Hardy WESTBROOK all of my land no above mentioned and all of the land that I lent to my wife after her lifetime or widowhood and all of the stock that my wife leaves at her decease or widowhood and house hold and kitchen furniture except two beds, bed stids and furniture for the same and our table and chest left for her to dispose of as she may think proper at her decease. Id o also desire that my Executor would take my son Wm. H. H. WESTBROOK home with him and give him as much education as he may think proper and learn him how to farm it. I do hereby appoint Benjamin STANLY my Executor of this my Last Will and Testament and hereby revoking all former Wills by me made. NOBLE State of North Carolina Court of Pleas and Quarter Sessions Jones County July Term 1848 In Open court then the Execution of the last Will and Testament of Harman WESTBROOK was proved in due form of law by the Oaths of Wm. RHODES and Benjamin RHODES two of the Subscribing witnesses thereto and at the same time Benjamin STANLY the Executor therein named came into court and relinquished all right title and intent to Qualify as Executor to said last Will and Testament whereupon William CARR came into court and was appointed Administrator to the said last Will and Testament with the will annexed And was qualified as Executor to the said last Will and Testament & the said last Will and Testament of the said Harman WESTBROOK dec'd was ordered to be Registered. -- HAMMOND, C.C.C.
