All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm File contributed for use in USGenWeb Archives by Sloan Spence Mason WILL OF JOHN WESTBROOK, Jr. Written 26 May 1846 Probated 1846 Book B, page 167 In the Name of God, Amen, I John WESTBROOK of the county of Jones and State of North Carolina being Weak in body but of sound and perfect mind and memory blessed be Almighty God for the same do make and publish this my last Will and Testament in manner and form of following (that is to say) First: I give and bequeath unto my beloved wife Pheby WESTBROOK all of my house hold & kitchen furniture also two cows and calves & all of my stock of hogs & all of my stock of sheep & geese and one young mare by the name of Fance and I do also give and unto my beloved wife Lend? Unto my beloved wife during her lifetime or widowhood a certain portion of my cleared land that is to say all of my plantation Westward of a crop fence that is cross my plantation & joining of my brother Harman WESTBROOK'S plantation also all of the cleared land under fence where I now live and privaledge of the woodlen lands for fire wood & rale timber for the support of the above mentioned plantations I do also lend unto my beloved wife one Negro man by the name of TED to her use and to assist in making of support for my sons & daughters during her life time or widowhood. I also desire that my beloved wife should keep all of my children together with her until they come of the age of Twenty one years old if she and they all should live that long, I do also desire that my beloved wife & my Executors to have my children educated as fare as they may think proper (that is to say) reading & writing & plain arithmetick. I desire that the balance of my cleared My Executor should rent them out to the best advantag, keep up good fence & keep the ditches cleaned out & also rent out my turpentine boxes? And the funds that will on my arise from the rent of lands & boxes to be kept for my children until the oldest one comes of age and then give him or her their equal part of the funds that has risen from the rent of land & boxes. And I also desire that my lands should be equally divided amongst my children at the decease of my wife if she should live until the youngest comes of age. If she should not live until my youngest child comes of age, then all of the lands to be rented out until the youngest comes of age. I do also give and bequeath unto my son John WESTBROOK my Negro man TED after the decease of my beloved wife if he is servisable. If he is past labour I desire that each one of my heirs should pay his part towards supporting of said Negro man TED. I also desire that my Executor after giving off my wife one years provison for her debt?, her family & stock? What three free holders may a lot her to sell the balance not mentioned in my Will and the funds arising from the sale and what is now diew me to pay my just debts and if anything be left after paying my just debts to be equally divided amongst my children if here should not be enough collected from the sale & what is diew me at present collect enough out of the rent to pay my just debts. I do hereby appoint Nathan STANLEY my for my Executor of this my Last Will and Testament, In witness where of I have hereunto set my hand and seal, this 26th day of May 1846.
