JOHN & SLADE GATLIN TO JOHN & BENJAMIN SUTTON COURT WARRANT, 1809 State of North Carolina } To the constable given here you are Lenoire County } commanded to summons John Sutton for to appear before me or some Justice of the Peace for said county within thirty days from the date hereof to show cause why he duly paying Slade Gatlin the sum of twenty one pounds two shillings and duly. Assumpsit and this shall be for a lawfull warrant given under my hand & seal the 1 of Feb 1809 Jno Gatlin, J.P. [Back side] And that of the written warrant prepared against the defendent for the sum twenty one pounds two shillings recd and book the 1 of Feb 1809 Jno Gatlin, J.P. Stay of Execution } a- greeable to law by giving Benjamin & John Sutton his Recd five pounds Benj X Sutton in part the 1 Feb 1809 mark Slade Gatlin John Sutton END OF DOCUMENT Comments: Although Benjamin had a brother named, John, Benjamin’s son, John (born ca. 1779), would have been an adult at this time, approximately 30 years old. It is more likely that the John named in this document is the son of Benjamin, given Benjamin appears to be interceding for him. Of significance, it appears that John Sutton signed his own name, providing additional proof this was most likely Benjamin’s son. The elder John, brother of Benjamin, was illiterate in all likelihood, as was Benjamin, and would not have been able to sign his name. Re: Slade Gatlin b. Bef. 1773; d. July 13, 1809.
