BENJAMIN SUTTON SURVEY, 1790 [Diagram shows a right triangular plot of land with a hand and finger pointing toward it. Wrapped around and within the diagram are the following words :] E.+220 poles No. 52 40 acres Land down pr. Scale 100 poles to the Inch. State of No. Carolina by Wart. No. 3 dated 12th August 1790 I have Surveyed a Tract of Land for Benjamin Sutton Containing Forty acres lying in Dobbs County Beginning at a gum Burnetts corner and runs with his line East two hundred and twenty eight poles to a gum Thos Uzzells [torn] line North fifty two poles near [torn] Beg. Corner a Sweet gum then with his [torn] line to the Beginning. December 8th ?? Arthur Maxwell } C? John Sutton } [torn] ?? Surv. END OF DOCUMENT Comments: The John Sutton named in this document would not have been Benjamin’s father, John (b. ca. 1730; d. bef. 1773), since he died before 1773 which pre-dates the 1790 year indicated in the survey. Benjamin had a son named, John, born ca. 1779; however, he would not have been the John Sutton named herein since he would have been only about 11 years of age at the time and not of legal age to serve as an apparent witness for the survey. This John Sutton identified in this survey is most likely Benjamin’s brother, John, Jr. (b. ca. 1758), making him about 32 years old a time the survey was prepared and written. The 1790 Census for Dobbs County identifies only one John Sutton classified as age 16 and upwards, which would have been the brother of Benjamin.
