The reference to Benjamin Sutton (b. ca. 1752; d. 1837), son of John Sutton (b. ca. 1730; d. bef. 1773), as a landowner would suggest that Benjamin was of legal age, minimally, 21 years old at the time this document was prepared and written. A circa date of 1773, then, could be assigned to it. John Sutton named herein would not have been Benjamin’s father, John (b. ca. 1730) since he died before 1773. Rather, this John was Benjamin’s brother, John, Jr. (b. ca. 1758; d. 1820-1830). In order to have served as a witness for this document, John, Jr. also had to be of legal age or at least 21 years old. Therefore, a more likely circa date of 1880 has been assigned to this document.
