Metts vs Mortimer Bight and Watson Wilcox – Trespass – case agreed John Stephens was indebted to the firm of J. & J. C. Washington and secured by a deed of trust dated __ day of ___ to James E. Metts as trustee – property left in the possession of sd Stephens – deed proven before Lewis C. Desmond, Clerk, and registered the same day at 7:00 pm – on the same day at 9:00 pm the firm of Wilcox and White of which def Wilcox was a partner obtained judgment before a JP against sd Stephens and by direction of sd Wilcox and levied by def Bright on the property – the deed did not give the day it was recorded – just the time Another statement indicates the year of the deed was 1837 – some question as to whether the court was justified in issuing the judgment – Indenture – 7 Oct 1837 – John Stephens of the first part, James E. Metts of the 2nd part and J. and J. C. Washington by J. C. Washington the surviving partner – sd Stephens indebted to sd J. and J. C.
