WOOTEN, ADMR de bonisus vs SARAH JARMAN North Carolina Supreme Court Case found at the NC Archives Lenoir County, Dec. 1858 Action to recover damages for the slaves Chaney and her children, Maria, Hardy, Phelie, Hannah, Catherine - the woman Chaney was the property of Wendall Davis of Lenoir Co. who in 1837 put them in the possession of his daughter, the def, Sarah Jarman In 1833 sd Wendall made his will and died in 1848 – the sd will was offered to the county and was contested – it was finally admitted for probate in the 1851 Court with John Davis as one Administrator On 31 Dec. 1856 sd John Davis demanded the Negroes from sd Jarman because the children were born since 1838 and she had only been given Chaney – sd Jarman refused to surrender them – they were worth $3,000 at the time George Jones was appointed Admr during the controversy John Davis died after the suit and William T. Wooten was appointed Admr. The def said she would not get a fair hearing because it had been too many years On 19 Sept 1857 came to Court William Pollock, Sheriff of Jones Co where the def, Sarah Jarman, lived On the jury were Elisha Grady, Council Hooten, Pinckney Hardee, L. C. Desmond, B. C. West, Jobe Smith, Chauncy Gray, James L. Cannady, Noah J. Allen, J. S. W. Pearce, John Jackson, Samuel N. Croom Supreme Court found for the def. It is unfortunate the Will was not in the file.
