North Carolina Supreme Court Case found at the NC Archives

John Tull vs William J. Pope

This case as found in NC Report appeared in the February 2010 issue of the 
Newsletter. Below is the abstract from the case file that in this case does 
add a little genealogical information not found in NC Reports.  The object is 
to see the difference in what is in the NC Reports from the legal standpoint 
and what is in the actual case file from the genealogical standpoint.

W. J. Pope, J. F. Parrott and J. C. Kennedy are indebted to John Tull of $500 
on 4 Nov. 1872

John C. Washington on 31 Jan. 1861 executed a note to John Tull for $512.80 
plus interest – Tull then endorsed the note to Stephen White, now dec.  The 
understanding was that White was to expect sd Washington to pay the note – sd 
White was a merchant in Kinston and Tull traded with him.

William White was the Admr of the estate of Stephen White and his son.  After 
the death of Stephen White, John I Coleman was employed by William White to 
post the books and accounts.

William White died in 1871 and James W. Harper was appointed as acting Admr. 
and sold the note to Pope.

It mentions that William White was the son in law of one R. F. Green and Green 
had died before the trial and J. P. Bryan rented his house. Sd Bryan 
accidentally found the accounts books in the rented house in a closet.  The 
books had never been out of Kinston but the Admr. Was ignorant of the sd books.
