Mason File:ROUSE:18863-38 Lent for copying by Russell KING (ROUSE/GRIFFIN) This Indenture made this, the eleventh day of October, A.D., one thousand eight hundred and seventy, between Benjamin ROUSE and wife Mary of the County of Lenoir and state of North Carolina, of the first part, and John W. ROUSE of the same county and state of the second part, witnesseth that for and in consideration of the sum of one hundred and fifty dollars to them in hand paid; the receipt whereof is hereby acknowledged, the said party of the first part have given, granted, bargained, sold and conveyed and by these presents do give, grant, bargain, sell and convey unto the said John W. ROUSE, his heirs, and assigns, all that piece parcel of land, situate, lying and being in the County and State aforesaid near the ------- of the said Benjamin ROUSE and --------- did as follows: Beginning at a stake at the upper? Side of Kinston Road and runs astwardly with said 70 yards; then Southwardly, at right angles with said, road 70 yards; then westwardly parallel with said road 70 yards; then to the beginning containing one acre, be the same more or less. To have and to hold the same to the said John W. ROUSE, his heirs and assigns, together with the Gin house and the Screw? Cotton press and also the Cotton gin in the said gin house now standing on the said land, with all the privileges and appurtenances thereunto belonging or in anywise appertaining to him and his heirs and assigns in Fee Simple, forever.And the said party of the first do covenant and agree to and with the said party of the second part to warrant and forever defend the title to the premises with the appurtenances against the claim or claims of any and all persons whatsoever.And the said party of the first part do further covenant that they are seized of the increases in fee simple and of right can make and convey such an estate and have done the same by their presents.In testimony whereof we have hereunto set our names and affixed our seals, the day and date above written.
