Transcribed by Sloan Mason James H. BELL to Joseph W. BROTHERS-1875 This Indenture made this the 16th day of December in the year of our Lord eighteen hundred and seventy five by and between James H. BELL and wife Mary J. BELL, of the County of Lenoir and State of North Carolina of the first part and Joseph W. BROTHERS of the same county and state aforesaid (of the second part) Witnesseth, that the parties of the first part, for and consideration of the sum of two hundred dollars the receipt of which is hereby acknowledged have given granted, bargained, sold and conveyed, and do hereby give, grant, bargain, sell and convey to the said parties of the second part, his heirs and assigns a certain piece or parcel of land situated on the south side of Wheat Swamp in the state and County aforesaid being bounded as follows, Beginning at a stake at the Duck pond and runs N 49 W 64 poles thence S 49 West 42 poles to a stake thence S 46 W 31 1/2 poles ----- Thence S 10 W 37 poles to a stake thence S 10 E 34 poles a stake and a lightwood log on Alexander WILSON'S line, then south WILSON'S line to a black jack, Miller R. CHURCH'S line then with CHURCH'S line to the beginning N 17 E 68 poles containing by estimation 46 acres more or less which is all of our right title and interest in the tract of land known as the CADE land to have and to hold the said granted land with all the buildings improvements and appurtenances therein belonging unto the said parties of the second part his heirs and assigns in fee simple forever, and the said parties of the first part for the sum their heirs executors and administrators covenants and agrees to and with said party of the second part his heirs that they will forever warrant and defend said premises hereby conveyed to the said party of the second part and his heirs against the claim or claims of any and all persons whatsoever and then do further covenant that the said James H. BELL are seized of the premises in fee simple and have power to make and convey such an estate by this indenture and have done the same by these presents. In testimony whereof the said parties of the first part have hereunto set their hands and seals on the day and year above written, signed, and sealed this 16th day December 1875. James H. BELL and Mary J. BELL his wife, the persons described in, and who signed, the foregoing Deed, and acknowledged the due execution thereof by them as their act and deed. And thereupon the said Mary J. BELL being by the undersigned privately examined separate and apart from her said husband, touching her free consent in the execution thereof, doth declare on such her examination, that she had executed the same freely, of her own will and accord, and without any force, fear or undue influence of her said husband or any other person, and did still voluntarily assent thereto. Therefore let the said Deed, with this Certificate, be Registered. Witness my hand and official seal. Wm. W. N.
