S. BROADWAY to W. C. FIELDS of Lenoir Co., NC 4 May 1880 State of North Carolina Lenoir County The Deed made this the fourth day of May 1880 by E. S. BROADWAY of Lenoir County and State of North Carolina to W. C. FIELDS of Lenoir County and State of North Carolina Witnesseth that said E. S. BROADWAY in consideration of thirteen hundred & fifty dollars to him paid by W. C. FIELDS, the receipt of which is hereby acknowledged have bargained and sold, and by these presents do bargain, sell and convey to the said W. C. FIELDS an this heirs a tract or piece of land in Lenoir County, State of North Carolina adding the lands of MILLER & CANADY, the heirs of H. J. McCOY and others, bounded as follows West by Dawson Street, East & South by the lot of MILLER & CANADY & North by the lot of H. J. McCOY’S hits, being 213 feet in Dawson Street & being the Store house now occupied by J. H. KINSEY in the town of Kinston, NC one other tract of land of C. M. TILGHMAN, Council PHILLIPS & C. F. ALBRITTON knowns as the “Joseph TILGHMAN” LANDS CONTAINING TO WIT 498 ACRES MOR OR LESS, AND MY INTEREST IN THAILAND KNOWS AS THE “CLARK Place” in Sand Hill Township, adjoining the lands of W. H. WEST & J. S. W. PEARCE, belonging to the estate of my father J. W. BROADWAY, Dec’d, containing about 350 acres. To have and to hold the aforesaid tracts or parcels of land and all privileges and appurtenances thereto belonging to the said W. C. FIELDS his heirs and assigns to their only use and behoof. And the said E. S. BROADWAY covenants that he is Seized of said premises in fee, and has right to convey the same in fee simple, that the same and free from all encumbrances, and that he will warrant and defend the Said title to the same against the claims of all persons whatsoever. Provided, nevertheless, that if the said E. S. BROADWAY of the first part he is heirs electors administrators, shall will & truly payer cause to be paid to the said W. C. FIELDS party of the Second part his heirs executors, administrators, or assigns, the sum of thirteen hundred & fifty dollars according to the condition of 3? certain Bonds of even dale? herewith payable to W. C. FIELDS as follows: in 15th Dec. 1882, $450 & interest at & percent from date in the 15th Dec. 1883 $450 & interest at & per cent & in the 15th Dec. 1884. $450 & interest at 8 per cent from date till paid then the Deed to be null and void: otherwise to be in full force and of fact, But if default shall be mad win the payment of the said Sum of money or the interest or any part thereof at the time heretofore specified for the payment thereof the said party of the first part in such case —- hereby authorize and fully empower the said party of the Second part his heirs, executors, administrators, and assigns, upon written notice to party of the first part for 90 days that prompt payment is extracted and in default thereof sale will be mad under the powers of the mortgage to see the said hereby granted premises at public auction at the C. H. in Kinston, NC after first advertising the same at three or more public places or in some newspaper published in Lenoir County, for 20 days and convey the same to the purchaser in fee simple and put of the moneys arising from such sale to release the principal and interest which shall then be due on the said Bonds together with all costs and charges and pay the surplus (if any) to the said party of the first part his heirs executors, administrators or assigns.
