DUPREE 28 November 1898 Bk. 23, p. 213 This Indenture made this 28 day of November in the year of our Lord One Thousand eight Hundred and Ninety Eight between Mrs. Martha TAYLOR of the county of Lenoir and State of North caroling of the one part and W. C. FIELDS, Guardian to minor Heirs of J. F. DUPREE, Dec’d of the County of Lenoir and State of North Carolina of the second part: Witnesseth, That the said party of the first part for and in consideration of the sum of Three Hundred and Fifty Dollars in hand paid by the said party of the second part, the receipt where of is hereby acknowledged has bargained and sold, conveyed and confirmed, and by these presents does bargain sell convey and confirm unto the said party of the second part his successors forever all the following described piece or parcel of land lying and being in the county of Lenoir, Vance Township, State of North Carolina and known and designated as follows, viz: Bounded on the North by lands of T. H. HEATH, on the South by lands of Mrs. Olivia C. POPE, on the West by the lands of Lem TAYLOR & Elijah FIELDS and on the East by the lands of Susan A. ALDRIDGE, containing Eighty nine acres more or less. To Have and to Hold the same, together with all the hereditaments and appurtenances thereunto in anywise appertaining to him the said W.C. FIELDS, Guardian his successors Forever, and the said Mrs. Martha TAYLOR party of the first part does covenant with the said party of the second part his successors as follows: First, That she is the owner and lawfully seized of said premises, Second, that she has good right to convey the same, Third, that the same is free from all encumbrances whatsoever, and Fourth, that the party of the second part his successors shall quietly enjoy and possess the same and that she will warrant and defend the title to the same against all lawful claims; Provided nevertheless That if the said Mrs. Martha TAYLOR of the first part her heirs, executors and administrators, shall will and truly pay or cause to be paid to the said W. C. FIELDS, Guardian party of the second part his successors the sum of Two Hundred and Fifty Dollars according to the condition of a certain bond of even date herewith payable in three yearly installments of $116. 67 & interest on whole amt. on the 1st of Nov. 1899-1900 & 1901. Then this deed to be null and void otherwise to be in full force and effect. But if default shall be made in the payment of either of the said sum of money or the interest, or any part thereof, at the time herein before specified for the payment thereof the said party of the first part in such case does hereby authorized and fully empower the said party of the second part his successors to sell the said hereby granted premises at public out cry at the County Courthouse door in Kinston, Lenoir County after first advertising the same Thirty days at 4 public places in said County or as may be prescribed by Law for such sales and convey the same to the purchaser in fee simple, and out of the moneys arising from such sale to retain the principle and interest which shall then be due on the said Bond together with all costs and charges, and pay the surplus, if any to the said party of the first part her heirs, executors administrators & assigns. In Testimony whereof the said party of the first part has hereunto set her hand and seal the day and year first above written. Martha TAYLOR (Seal) Signed, sealed and delivered in the presence of E. J. BECTON North Carolina Lenoir County The execution of the forgoing instrument was this day proven before me but he oath and examination of E. J. BECTON the subscribing witness thereto. Let the same with this certificate be registered. This 23rd day of Nov. 1898. S. H.
