C. DUPREE 11 Jan 1902 This Indenture made this 11th day of January in the year of our Lord 1902, between Samuel TAYLOR and Franklin TAYLOR of the County of Lenoir and State of NC, of the first part and W. C. DUPREE of the county of Lenoir and State of North Carolina, of the second part: Witnesseth That the said parties of the first part for and in consideration of the sum of One hundred and Forty Dollars, in hand paid by the said parties of the second part, the receipt whereof is hereby acknowledged, had bargained and sold, conveyed and confirmed and by these presents do bargain, sell, convey and confirm unto the said party of the second part, his heirs and assigns forever, all the following described piece or parcel of land, lying and being in Neuse Township and known and designated as follows, viz: Beginning at a maple in the runoff Spring Branch and runs North 41 poles to a post oak (lightwood stake now) thence North 230 West 93 1/2 poles to a stake thence North 70 East 90 Poles to a black gum thence South 10 East 160 poles to main run of South West Creek, thence up the run of said Creek to the mouth of Spring Branch then up Spring Branch 100 poles to the Beginning Containing Eight acres more or less by estimation. To have and to hold the same together with all the hereditaments and appurtenances thereunto in any wise appertaining to him, the said W. C. DUPREE his heirs and assigns Forever, and the said Samuel & Frank TAYLOR party of the first part, does covenant with the said party of the second part heirs and assigns as follows: First that we are the owner and lawfully seized of said premises. Second that we have good right to convey the same. Third, that the same is free from all encumbrances whatsoever. And Fourth, that the party of the second part, heirs and assigns shall quietly enjoy and possess the same, and that we will warrant and defend the title to the same against all lawful claims; Provided Nevertheless, that if the said Samuel & Franklin TAYLOR of the first part heirs, executors and administrators shall, will and truly pay or cause to be paid to the said W. C. DUPREE party of the second part, heirs, executors, administrators or assigns the sum of One Hundred and Forty Dollars, according to the Condition of a certain bond of same?, date herewith payable Dec. 15, 1902. Then this deed to be null and void; otherwise to be in full force and effect. But if default shall be made in the payment of either of the said sum of money, or the interest, or any part itself at the time be such before specified for its payment thereof, the said party of the first part in such case does hereby authorize and fully empower the said part of the second part heirs, executors administrators and assigns & all the said hereby granted premises at public out cry at the Court House door in Kinston, Lenoir County after first advertising the same 30 days at three public places, and covering? the same to the purchase in fee-simple and out of the moneys arising from such sale, to retain the principle and interest which shall then be due on the said notes together with all costs and charges and pay the surplus if any, to the said part of the first part, heirs, executors, administrators or assigns.
