DUPREE 19 Nov. 1901 Bk. 26, p. 581 This Indenture this 19th day of November in the year of our Lore one thousand one hundred and one between Elijah FIELDS, and wife Winny FIELDS of the County of Lenoir and State of North Carolina of the first part, William C. FIELDS, Guardian minor heirs J. F. DUPREE, Dec’d, of the County of Lenoir and State of North Carolina of the second part. Witnesseth that the said parties of the first part, for and in consideration of the sum of Four hundred and nine dollars ($409.00), in hand paid by the said party of the second part, the receipt whereof if hereby acknowledged, now bargained, and sold, conveyed and confirmed and by these presents do bargain, sell, convey and confirm unto the said party of the second part his heirs and assigns, Forever, all the following described piece or parcel of land, lying and being in the County of Lenoir in Contentnea Neck Township and — and designated as follows viz: one piece on which is situated the house in which the said FIELDS & wife now reside containing about (blank) acres, which was deeded to Elijah FIELDS by said W. C. FIELDS; another piece which was allotted to said Elijah FIELDS in the division of his sisters (Julia A. NEWSOM land) and containing about 10 acres - and one other piece which was allotted to said Elijah FIELDS in the division of his mother (Mrs. Phinton? W. FIELDS) land all of which lands adjoin and all surrounded by the lands of Mrs. Ollie C. POPE, Ed. HUNTER, Mrs. Susan A. ALDREDGE, the “Alex FIELDS’ heirs of land upon which Jesse FIELDS now farms & lives. The lands conveyed of intended to be conveyed hereby being all the lands owned by said Elijah FIELDS & wife in Lenoir County. To have and to hold the same together with all the hereditaments and appurtenances thereunto in, anyway, appertaining to him the said Wm. C. FIELDS, his heirs and assigns forever and the said Elijah FIELDS & wife Winney FIELDS parties of the first part do consent with the said party of the second part his successors and heirs and assigns as follows: First, That they are the owners and lawfully seized of said premises. Second, That they have good right to convey the same. Third; That the same are free from all encumbrances whatsoever; And Further that the party of the second part his heirs and assigns shall quietly enjoy and possess the same and that this will warrant, and defend the title to the same against all further claims Provided Nevertheless, That if the said Elijah FIELDS & wife Winny FIELDS of the first part their heirs executors and administrators shall will and truly pay or cause to be paid to the said Wm. C. FIELDS, Guardian party of the second part his heirs, executors, administrators or assigns the sum of four hundred and nine Dollars, according to the Condition of a certain bond of corn date herewith payable as follows, on Jany. 1/1903, $100 on Jany. 1st 1904-$100 on Jany. 1st 1905, $100; on Jany. 1st 1906, $50 or balance of principal & —- Jany. 1, 1907. Then this deed to be null and void, otherwise to be in full force and effect. But if default shall be made in the payment of either of the said su of money, or the interest, or any part thereof, at the time herein before & specified for the payment thereof, the said parties of the first part, in such case Is hereby authorized and fully empower the said party of the second part his heirs, executors, administrators and assigns, to sell the said hereby granted premises at public out cry at the Court House door in Lenoir County after first advertising the same for 30 days at four public places in said County and convey the same to the purchaser in fee simple and out of the moneys arising from such sale, to retain the principal and interest which shall then be due on the said bond together with all costs and charges, and pay the surplus if any to the said parties of the first part their heirs, executors, administrators and assigns. In Testimony whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written. STANLY, Justice of Peace do hereby certify that Winnie FIELDS, personally appeared before me this day and acknowledged the due execution of the annexed Deed of Mortgage and the said Winnie FIELDS, being by me privately examined separate and apart from her said husband, touching her voluntary execution of the same doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or of any other person and that she doth still voluntarily sort thereto.
