DUPREE 30 May 1904 This Indenture, made this 30 day of May 1904, by and between E. B. LEWIS & wife, Dora M. LEWIS, of the county of Lenoir and State of North Carolina, parties of the first part and Plato COLLINS, Clerk of Superior Court of Lenoir County, North Carolina and also the Receiver of the estate of Josephine DUPREE, Sadie DUPREE, Sudie DUPREE and Peterson DUPREE, minors of the County of Lenoir and State of North Carolina, party of the second part; Witnesseth: That the said parties of the first part for and in consideration of the sum of Two Thousand and one Hundred and forty five dollars and seventy seven cents ($2145.77) in hand paid by the party of the second part, the receipt whereof is hereby fully acknowledged, have bargained and sold, conveyed and confirmed, and by these presents do bargain and sell and convey and confirm unto the party of the second part, and his successors in office, forever, all the following described piece or parcel of land, lying and being in the town of Kinston, Lenoir County, North Carolina and known and designated as follows viz: Beginning at the south west corner of Caswell and McLewean Street in the town of Kinston and runs West with Caswell Street one hundred and five feet to N. J. ROUSE’S Corner, thence South with said ROUSES line to Mrs. Anna H. ASHFORD’S Corner; thence east with the said Mrs. Anna H. ASHFORD’S line, one hundred and five feet to McLewean Street; thence North with McLewean Street to the beginning. To have and too hold the above described piece or parcel of land, together with all the hereditaments and appurtenances thereunto in anywise appertaining to him, the said party of the second part and his successors in office and assigns forever. And the said parties of the first part do hereby covenant with the said party of the second part and his successors in office and assigns, as follows; First: That they are the owners and lawfully seized of the said premises. Second: —— and right to convey the same. Third: That the same is Free and clear from all encumbrances whatsoever. And Fourth: that the said party of the second part, and his successors in office and assigns shall quietly enjoy and possess the same and that they will warrant and defend the title to the same against all lawful claims: Provided nevertheless, that if the said parties of the first part, their heirs executors and administrators, shall will and truly pay or cause to be paid to the said party of the second part his successors in office or assigns the sum of Two Thousand and One Hundred and forty five and 77/100 dollars ($2145.77) according to the condition of a certain bond of ever? date herewith payable on the 30th day of May Nineteen hundred and five, then this deed to be null and void; otherwise to be in full force and effect. But if default to be made in the payment of either of the said sum of money, or the interest, or any part thereof, at the time herein before specified for the payment there of the said parties of the first part, in such case do hereby authorize and fully empower the said party of the second part his successors in office and assigns to sell the hereby granted premises at public outcry at the Court House door in Kinston, Lenoir County, after first advertising the same for thirty days at the said Court House door and at three other public places in said County and convey the same to the arising from such sale, to retain the principal and together with all costs and charges and pay the surplus if any to the said parties of the first part, their heirs, executors, administrators or assigns. LEWIS his wife appeared before me this day and acknowledged the due execution of the annexed deed of conveyance; and the said Dora M. LEWIS being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband or any other person, and that she doth still voluntarily assent thereto. LEWIS his wife, to Plato COLLINS, Clerk of the Superior Court of said County and receiver of the estate of Josephine, Sadie, Sudie and Peterson DUPREE, minors and his successors in office having bee probated by W. A. MITCHELL, a Notary Public on and for Lenoir County as evidenced by his certificate and notorail seal and the records in the office of the Clerk of the Superior Court of Lenoir County which certificate of Probate is adjudged to be in due form and according to law, and it appearing that the party of the second part is Clerk of Superior Court of said County. It is therefor ordered that said Mortgage Deed and the Certificates be registered in the Office of the Register of Deeds of Lenoir County, NC. Witness my hand this 31st day of May 1904. O. N.
