This Indenture, made this 22 day of July in the year of our Lord, one thousand eight hundred and ninety eight between Geo. W. HOLLAND and Caroline HOLLAND his wife of the County of Lenoir and State of North Carolina of the first part and Wm. C. FIELDS Guardian to minor Heirs Jesse DUPREE, dec’d. of the county of Lenoir and State of North Carolina of the second part; Witnesseth that the said parties of the first part for and in consideration of the sum of nine hundred and nine & 22/100 dollars in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged has bargained and sold, conveyed and confirmed and by these presents do bargain sell convey and confirm unto the said party of the second part his successors forever, all the following described piece or parcel of land lying and lying in Neuse Township, Lenoir county, State of North Carolina and known and designated as follows viz: Beginning at a bunch of bays by the side of the West prong of Whitely’s Creek, Admiral CROOMS corner thence South 12 East 32 poles along said CROOMS line to a stake then with said CROOMS line to DAWSONS corner, South 80 East 200 poles to a small Hickory then South 16 East 59 poles to the road The said Hickory being the commencement of the dividing line between Geo W. HOLLAND and W. J. HOLLAND then North 157 poles to WILKINS line then North 20 ½ West 26 poles to the Creek then up said Creek to the beginning containing 147 acres more or less being the tract which was deeded by Nancy HOLLAND to Geo. W. HOLLAND the 15th day of Feb. 1898 recorded in Book 3 Pages 23 & 24 Register’s Office of Lenoir County we also sell and convey to said FIELDS “Guardian” one bay horse, one sorrel mare about 3 years old and our farming imblements of every description. To have to hold the same together with all the hereditaments and appurtenances there unto in anywise appertaining to him the said W. C. FIELDS Guardian his successors, Forever, And the said Geo. W. HOLLAND & wife Caroline HOLLAND parties of the first part & his successors as follows: F first, that they are the owner and lawfully seized of said premises, Second, that they have good right to convey the same, Third, that the same is free from all incumbrances whatever, and Fourth, that the party of the second part his successors shall quietly enjoy and possess the same and that we will warrant and defend the title to the same against all lawful claims: Provided nevertheless, That if the said Geo. HOLLAND and wife of the first part their heirs, executors and administrators shall will and --- pay increase to be paid to the said W. C. FIELDS Guardian party of the second part his successors the sum of nine hundred & nine & 22/100 Dollars, according to the conditions of a certain bond of even date herewith payable in installments of $75. 77/100 & interest on whole amount then due payable on the 1st days of December 1898, 1899, 1900, 1901, 1902, 1903, 1904, 1905, 1906, 1907, 1908 & 1909 then this deed to be null and void, other wise to be in full force and effect, But if default shall be made in the payment of either of the said sum of money or the interest or any part thereof at the time herein before specified for the payment thereof the said parties of the first part in such case do hereby authorize and fully empower the said party of the second part his successors to sell the said hereby granted premises at public notary at the Court House door in Kinston Lenoir county after first advertising the same for thirty days at 4 public places in said County or as may be prescribed by Law for such sales and convey the same to the purchaser in Fee Simple and out of the moneys arising from such sale to retain the principal and interest which shall then be due on the said Bond together with all costs and charges and pay the surplus if any to the said parties of the first part their heirs executors administrators or assigns. In Testimony, whereof the said parties of the first part have thereunto set their hands and seals the day and year first above written. Geo W. HOLLAND and Caroline HOLLAND his wife personally appeared before me this day and acknowledged the due execution of the annexed deed of mortgage and the said Caroline HOLLAND being by me privately examined separate and apart from her said husband touching her voluntary execution of the same doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or of any other person and that she doth still voluntarily assent thereto, Witness my hand and Material seal this 8th day of August 1898.
