BROTHERS-1874 This Indenture made their the 22nd day of August in the year of our Lord eighteen hundred and seventy four by and between Thomas HUGHES and wife Ann Moriah HUGHES of the County of Lenoir and State of North Carolina of the first part, and J. W. BROTHERS of the same County and state aforesaid of the second part. Witnesseth, that the parties of the first part for and in consideration of the sum of five hundred dollars to him in hand paid (the receipt of which is hereby acknowledged) have given, granted, bargained, sold and conveyed and do hereby give grant, bargain sell and convey to the said party of the second part his heirs and assigns a certain tract of parcel of land situated lying and being in the county of Lenoir on the west side of Wheat Swamp adjoining the lands of Alexander WILSON, deceased; Martha KENNEDY and others and bounded as follows, viz: Beginning at a pine and runs south 46 poles to a pine thence south 29 W, 54 poles to a post oak, thence south 2 west 24 poles to a stake thence south 35 west 74 poles to a stake in a pond in or near Alexander WILSON'S line thence south 42 E, 58 poles to a short strawed pine thence N 85 E 48 poles thence N 10 W 34 poles thence N 10 E 16 poles to a stake on a ditch thence north said ditch to William TIGHLMAN'S beginning corner thence with a line of marked trees to Martha KENNEDY'S line N about 75 E thence running with her line N 49 W to the beginning containing about eighty five acres more or less. The said described lands to have and to hold unto him the said J. W. BROTHERS and his heirs and assigns in fee simple forever and said parties of the first part for themselves their heirs executors and administrators covenants and agree to and with said party of the second part his heirs that they will forever warrant and defend said land with all the buildings and improvements thereunto the said land hereby conveyed unto him the said J. W. BROTHERS, and his heirs against the claim or claims of any and all persons whatsoever, and they do further covenant that the said Thomas HUGHES and wife Ann Moriah HUGHES are seized of the said premises in fee simple and have power to make and convey such an estate by this indenture and have done the same by these presents, hereunto set their hands and seals on the day and year above written. DAVIS Lenoir County In the Probate Court Be It Remembered, that on the 22nd day of August 1874, before the undersigned, Judge of Probate for said County, personally came Thomas HUGHES and Ann M. HUGHES his wife, the persons described in, and who signed, the foregoing Deed, and acknowledged the due execution thereof by them as their act and deed. And thereupon the said Ann M. HUGHES being by the undersigned privately examined separate and apart from her said husband, touching her free consent in the execution thereof, doth declare on such her examination, that she had executed the same freely, of her own will and accord, and without any force, fear or undue influence of her said husband or any other person, and did still voluntarily assent thereto. Therefore let the said Deed, with this Certificate, be Registered. Witness my hand and official seal. Wm. W. N.
