This is a re-registered Deed. Martha Mewborn Marble R. W. King to Wm. J. Pope - Whereas Reuben Phillips by Deed interest bearing date 21st day of April A.D. 1860 did convey to Richard W. King interest (to secure a note payable to John King) his interest being one fifth part of a tract of land lying and being in the County of Lenoir and State of North Carolina on the Southside of Great Contentnea Creek adjoining the lands of the late Charles Edwards, Mary E. Larougue, Pete Phillips and Stephen C. Phillips, being one fifth part of a certain tract of land loaned by the Will of Reubin Phillips, dec to Council Phillips dec and then given by the said Will to the lawful heirs of said Council Phillips and being that part or parcel conveyed by John James and wife Lucrecy to John King by deed bearing date 15th day of March A.D. 1858 and whereas the note given to said John King for one hundred and eighty four dollars dated 27th day of April 1860 and due lst day of June A.D., was sold by the administrator of said John King, and purchased by Wm J. Pope, said note being secured by the deed in trust as aforesaid, and whereas the said R. W. King, trustee as aforesaid agreeable to the promise of note did advertise the said lands at the Court House door in Kinston and three other public places in the County of Lenoir for the space of more than twenty days so required by said deed interest and expose the said land to public sale at the Court House door in the town of Kinston on the lst day of Nov A.D. l870 when the said land was bid off by Wm. J. Pope he being the last and highest bidder at and for the price of One Hundred Dollars. Now therefore this indenture made and executed this lst day of Nov 1873 between Richard W. King trustee of the said Reubin Phillips of the one part and Wm. J. Pope of the other part all of the County of Lenoir and State of North Carolina, Witneseth that the said Richard W. King trustee so aforesaid doth for and in consideration of the sum of One Hundred Dollars to him in hand paid by the Wm. J. Pope which as appeared to the payment of said note after deducting five per cent commisions the receipt whereof is hereby acknowledged hath bargained and sold and conveyed and by these present doth bargin, sell and convey unto the said Wm. J. Pope and his heirs, executors, administrators the said interest of the said Reubin Phillips in the aforesaid tract of land which has been deeded between and among the heirs of Council Phillips which agreeable to the report of the commissioners is described as follows viz: beginning at a stake the second corner of lot No 4 and runs North 3 East l26 poles to a stake then N 70 West 43 poles to a stake thence South 89 poles to an oak tree thence N 11 East 32 poles, thence N l East 9 poles to a pine thence S 666 E 32 poles to the beginning containing thirty ac more or less. To have and to hold etc R. E. King Trustee of Reubin Phillips signed and sealed in presence of Kate Brown December l9, 1885 [NOTE: I find this Deed confusing, but read it as follows: Reubin Phillips had a Will in which he "loaned" his land which was divided into 5 parts to his heirs: Council was one of those heirs: after Council died, a Reubin inherited as one heir. Also John James and wife Lucrecy had a share and Council had a daughter Lucrecy. This land was then auctioned to pay a debt. --MMM]
