Indenture: Mortgage from W.H.PADRICK to Sarah A. SUTTON, then to Hardy SUTTON-20 Feb. 1869-Lenoir Co.,N.C. Hardy SUTTON to W.H. PADRICK, mortgage-Enrolled-came to hand 3 o'clock, P.M.; February 20th 1869, and enrolled in the Registrars Office of Lenoir County --- --- thereafter. A.G. WADSWORTH, Reg. Of Deeds, page 261, book 37. At top of page-written in: This is to certify that I, W.H. PADRICK do this day transfer the within mortgage to Sarah A. SUTTON & her lifetime & then to Hardy SUTTON thence children. On side of 1st page is written: This is to certify that we Lenora A. EMERY & T.R. EMERY, guardian ad liteum for the children do this day --- for the within mortgage to A.H SUTTON and his heirs forever. Test: T.R. EMERY. Leland? Lillian and Lenora to have and to hold forever give under my hand and seal this the 2nd of September 1874. W.H. PADRICK. This Indenture made this the 20th day of February in the year of our Lord one thousand eight hundred and sixty nine between Hardy SUTTON of Lenoir Co. and State of North Carolina of the first part and W.H. PADRICK of said county and State of the second part. Witnesseth that the said Hardy SUTTON for and in consideration of the sum of one dollar to him in hand paid, the receipt whereof is hereby fully acknowledged has bargained, sold and conveyed, and does hereby bargain sell and convey to the said W.H.PADRICK the party of the second part, his heirs and assigns a certain tract or parcel of land lying and situate in Lenoir County and State of North Carolina; adjoining the lands of Jerry SUTTON, Thomas SUTTON and others containing two hundred and fifty three acres more or less. To have and to hold the same with the appurtenances thereunto belonging to W.H. PADRICK, the said party of the second part, his heirs and assigns forever. And the said party of the first part for the consideration aforesaid does hereby covenant and agree to warrant and defend the premises aforesaid to the said party of the second part his heirs, executors, administrators and assigns, against the claim and entry of all persons whatsoever, and the said Hardy SUTTON further covenants that he is seized of the premises in fee simple and has power to make and convey such an estate by this indenture, and has done the same by these presents. The condition of this indenture is such that whereas the said Hardy SUTTON is justly indebted to the said W.H. PADRICK in the sum of one thousand dollars, due by bond bearing even date with this indenture, as on reference to the bond will more fully appear: and whereas the said Hardy SUTTON is honestly desireous of securing the payment thereof. Now therefore if the said Hardy SUTTON shall on or before the 1st day of February A.D. 1870, fully pay off and discharge the said debt then this indenture and everypart and clause thereof shall be void; otherwise, to remain in full force and effect. In testimony whereof the said Hardy SUTTON has hereunto set his hand and seal the day and year above written. Signed, sealed, stamped, and delivered in the presence of: H.G. PADRICK was this 20th day of February 1869, acknowledged before the undersigned Judge of Probate for said County by the said Hardy SUTTON, therefore let the said mortgage with this certificate be registered.
