Mason File: PHILLIPS 16558-4 State of North Carolina Lenoir County Know all men by --- presents that I Council PHILLIPS & wife Rhody of the first part and Levi POWELL of the second part all of the county & state aforesaid. Witnesseth that for and in consideration of the sum of four hundred dollars paid by the second to the first party, the receipt whereof we hereby acknowledged, have bargained and sold unto the second party a certain tract of land situated in Lenoir Cty. On the north side of Rudy branch, and on the north side of Briary Swamp. Beginning at Levi POWELL'S corner in Rudy Branch. Thence with the branch to the main road, leading from Little Lester? Meeting house to Kinston. Thence up the road to a black Jack corner made between the said first party and Simon WILLIAMS. Thence with the dividing line between T.? C. PHILLIPS and WILLIAMS to Frederick BAKERS corner thence with his line to Levi POWELLS line thence with sd. POWELLS line to the beginning containing fifty six acres be the same more or less. To have and to hold the aforesaid bargained premises with all the appurtenances thereunto belonging or in anywise appertaining unto the party of the second part; his heirs & assigns forever, with the party of the first part forever ,-- ---- heirs, executors, administrators or assigns do hereby warrant and defend the title of said land against the claim or claims of all persons claiming in any manner whatever. There was the foregoing deed of bargain and sale from Council PHILLIPS and Rhoda his wife to Levi POWELL exhibited in open court, and the execution thereof duly acknowledged by the grantors and on motion, ordered that David W. LAWSON and William GRAY, Esqrs. be appointed to take the private examination of the said Rhoda PHILLIPS from coverts?, taking? Her free consent to the execution of said deed and report thereon under the direction of an act of the general assembly in said case made and provided, pursuant to the said order the said David W. LAWSON and William GRAY proceeded to take the private examination of the said Rhoda, separate and apart from her said husband and reported, that the said Rhoda from covert?, acknowledged that she executed said deed of her own free will and word?, all done?
